Democrat Ben Nelson Opposes Elena Kagan, Will Vote against her confirmation (Do you believe this?)

Nebraska Democrat Ben Nelson announced late Friday he would vote against the confirmation of Supreme Court nominee Elena Kagan.

In a statement released this evening, Sen. Nelson said, "I have heard concerns from Nebraskans regarding Ms. Kagan, and her lack of a judicial record makes it difficult for me to discount the concerns raised by Nebraskans, or to reach a level of comfort that these concerns are unfounded. Therefore, I will not vote to confirm Ms. Kagan’s nomination."

Nelson is the only Democrat to oppose Kagan at this point. Five Republicans, on the other hand, have said they will support Kagan's nomination, giving her more than enough votes to win confirmation. A vote is expected in the Senate late next week.

Nelson has sided with Republicans on a number of votes in the past, most recently the restoration and extension of unemployment benefits for the long-term jobless.

It means:

A) The Democrats have the votes, and

B) Nelson is worried and trying to get conservative credentials back.

I say, donate to his opponent and do your best to throw the bastard out at election time...which I think is 2012 for him.

Nelson's "NO" vote is flat out insincere, disingenuous and deceitful. It's totally misleading and Levin talked about it on his show tonight...

The last sentence in the article states:

"Nelson did note that if a procedural vote is held on Kagan, he will NOT filibuster, since he believes Kagan deserves an up or down vote."

So, he will VOTE yes to bring an up and down vote and will vote NO on Keagan knowing the RATS (and RINOS) have the VOTES to CONFIRM her! His "NO" vote is in effect a YES vote because he WILL NOT filibuster her. I guess Nelson and the ruling class think we're too damn stupid to recognize how dishonest his "no vote" claim is.....

Bad Hair Ben is hoping that he can convince the idiot republican Nebraskans who have supported him that he’s not really an obama butt boy but it won’t work this time. When you lose make like our other former POS governor/senator and stay on the east coast.

The fine GOP senator from Indiana, Lugar, is voting to install her as well. Indiana! Not Cali, or Oregon.. INDIANA! WTH?

He was the first GOPer to come out for Sotomeyer, too.

Wow, good for him. Making amends for his bad health care vote perhaps.

He knows his vote is meaningless, so he's choosing to score some points with his constituents. If he had the deciding vote, he'd vote for her.

Election year maneuvering. He must have special Obama dispensation to vote against Kagan, knowing that there are enough Senate votes without him. Folks back in Nebraska must still be pissed about the Cornhusker Kickback.

As others have said, I think this is little more than a move to make Nelson appear moderate/conservative to the voters back home. If Kagan’s support were in danger, Nelson would probably support her.

As it is, she’s already got Collins, Graham, Gregg, Lugar, and Snowe from the GOP, and I think maybe Lamar Alexander (not sure about that one). Nelson can be the lone “nay” vote and she’ll still probably sail through without much trouble.

Transparent BS. Nelson is trying anything he can to make the citizens of Nebraska to forget about his yes vote on Obamacare. If the dems have to have a yes vote from him on Kagan then he would vote yes.
