You mean January 5, 2013, right? (After the 2012 elections.)
Unfortunately, even with 64 GOP Senators, we would need at least 3 Democrats to vote to convict in order to remove a Supreme Court Justice. Or at least convince 4 Democrats not to show up that day so that 64 votes would be 2/3 of members present.
Do believe with a 64-36 majority, they could find at least 3 DINO's that want to be re-elected in 2014. After all, we give them at least that many RINOs for a lot of key votes!
