Come for the tapdance on ObamaCare, stick around for Howard Deans fantasy predictions in the Senate races this November. The clip picks up with Howard Dean discussing the meaning of the Missouri vote that had 71% of the electorate registering their opposition to the ObamaCare mandate to buy health insurance. Not to worry, Dean says, because the mandate was never going to survive anyway and he notes offhandedly that its almost certainly unconstitutional:

I'm just an engineer not a lawyer, so I may misunderstand this, but reading the comments over at Hotair, is appears that the democRATs forgot to put a Servability Clause in the healthcare bill. If I've got this right, the lack of a Servability Clause may cause the whole bill to be struck down if any part of it is found unconstitutional.

Yes, they forgot severability...
Something that is NEVER left out of ANY legislation,
so I was really surprised to see that they’d forgotten it.
However, I look for them to pull some sort of shenanigans,
like “deeming” it severable, etc.

Something I’m concerned about though...
These people, Dean included, have their eyes on THE prize - total federal control over whether or not individuals get health care.
So, even if he concedes that the mandate was unconstitutional all along, how do they still get the above goal implemented?

However, I look for them to pull some sort of shenanigans, like deeming it severable, etc. Nancy will certainly try to pull a fast one, but the whole thing with "deeming" was that the bill could not be changed in any way otherwise it had to go to conference. It was polly deeming it that screwed the rats in the first place.
