. . . an argument "over something trivial'' set off a chain of events inside the nightclub that led to Michael DiMarias death. DiMaria was one of three people struck by flying glass after Hector Guardiola allegedly tossed a heavy beer mug toward a man he had been arguing with inside the nightclub Sadly, there is nothing "bizzare" about this incident. It is all too common.

Guardiola, 25, of South Boston, today pleaded not guilty to charges of manslaughter and assault and battery with a dangerous weapon in Roxbury Municipal Court. Is he claiming that it wasn't him who threw the glass, or is he just claiming "not my fault!"?

Well, in the sense that innocent bystanders are commonly killed by the stupid actions of others just for being in the wrong place at the wrong time, yeah.

Not to make generalizations, because I have some roots there myself, but it does seem some of the dirtiest of dirtbags are found in bars in South Boston. I’m not referring to the victim.

That’s exactly what I was thinking when I made my comment. I have been to bars where people are way too quick to resort to violence and hurt bystanders. If anyone goes to bars like that, they need to be aware that things like this happen all too often. If you are a tourist and the bar looks seedy, stay away.

What Guardiola is doing is initiating a claim that the state of Massachusetts regularly buys into ~ that if you didn't have any intent to kill someone, then you are only going down for involuntary manslaughter, and the penalty will be time served (waiting for the bail bondsman).
It goes with the territory.
Years ago a couple of Mass thugs beat two Asian Americans to death with baseball bats. Since the Prosecutor couldn't decide which guy used which bat to kill which victim, they got off on involuntary manslaughter.
There are corollaries to this standard ~ for example, let a Kennedy drown you ~ no penalty.
These are all good reasons to just avoid going to MA.

DiMaria was one of three people struck by flying glass after Hector Guardiola allegedly tossed a heavy beer mug toward a man he had been arguing with inside the nightclub, according to prosecutors.
Authorities said DiMaria and the two other victims may have been acquainted with the man who argued with Guardiola, but they said none of the three victims had any role in the confrontation.
Polumbaum said the heavy beer mug tossed by Guardiola broke. DiMaria was struck in the throat, cutting through his jugular vein.
DiMaria was a 2009 graduate of Sacred Heart University in Fairfield, Conn., and had been working for a Wall Street firm, his sister said.
According to David O’Brien, father of Danielle O’Brien, a friend of DiMaria’s who was injured by glass shards, the trip to Boston was intended as a get-together among former college classmates.
His daughter told him that one member of their group of five had left their table at the popular bar to go to the bathroom and, along the way, inadvertently brushed into Guardiola. The two men had heated words but moments later, the friend returned to the table, not mentioning the incident.
