Sheriff Joe Arpaio's Response to the DOJ Lawsuit

The following is an official statement by Maricopa County Sheriff Joe Arpaio regarding today’s lawsuit filed against his office by the U.S. Justice Department in Washington, D.C. for alleged refusal to turn over documents. It is followed by another statement from his Washington, D.C. attorney, Bob Driscoll.

“The Obama administration has filed three lawsuits against Arizona in the last few weeks ... one against a college district, one against the state of Arizona and now one against my office. Each lawsuit centers on something to do with alleged racial discrimination.

These actions make it abundantly clear that Arizona, including this Sheriff, IS Washington’s new whipping boy. Now it’s time to take the gloves off.

As for today’s lawsuit against my office: These people in Washington met with my attorneys only a few days ago. And in that meeting, Washington got our cooperation; they admitted they already have thousands of pages of the requested documents; and they were given access to interview my staff and get into my jails.

They smiled in our faces and then stabbed us in the back with this lawsuit. The Obama administration intended to sue us all along, no matter what we did to try to avert it. Washington isn’t playing fair and it’s time Americans everywhere wake up and see this administration for what it really is. Calculating, underhanded at times and certainly not looking out for the best interests of the legal citizens residing in this country. “

STATEMENT OF ROBERT N. DRISCOLL,

COUNSEL TO SHERIFF JOSEPH ARPAIO AND THE MARICOPA COUNTY SHERIFF’S OFFICE

“Today’s lawsuit by the Department of Justice is part of a deliberate media strategy to “get tough” on Sheriff Arpaio and the Maricopa County Sheriff’s Office and undermine immigration enforcement by a local Sheriff who is trying desperately to make up for this Administration’s own indifference to the topic.

The DOJ suit speaks loudly by what it does not say. It does not allege that Sheriff Arpaio or the MCSO have discriminated against anyone because the DOJ, after 18 months of soliciting allegations against Sheriff Arpaio, has come up empty. Even the purported basis for the suit, which alleges a lack of “cooperation,” is a sham. In fact, after meeting with the DOJ last week, just last Friday, on behalf of MCSO, I informed the DOJ that MCSO would cooperate with all reasonable document requests and would schedule tours of MCSO facilities and interviews with senior MCSO command staff. We were awaiting a response from DOJ, and this lawsuit is apparently it. Clearly DOJ is more interested filing its third lawsuit in as many weeks against Arizona defendants than in looking into the allegations that purportedly gave rise to its investigation. This lawsuit is nothing more than an attempt to obscure the fact that DOJ still has no case. Today’s suit over documents does not change that.”

We have reason to fear for our safety here in AZ. And reports of beheadings and other violence south of the border ARE related to drug and human smuggling.
>>>>>>>>>>>>>>>>>>>>>>>>>>>>

Just wanted to flesh your statement out a bit.

The violence mentioned by Joe is more than “reports”

The reason everyone in Washington is able to deny the “reports” is because the Mexican government has a news blackout on all such incidents, journalists are put in jail if they report on them. Simultaneously, Obama has made sure that the MSM does not report the facts of what is happening in Mexico, and MSM journalists will not undergo the risk of going to Mexico to report them. The risks are real, journalists are favorite gun targets of the cartels.

The result is an ignorant US public, and a federal government that can say,” Its not happening!” LIES!
Typical fascist manipulation. Weneed to put the truth right into Obama’s lap!In public, in front of news cameras.

But the Mexican news is getting out through a blog run by a maverick web security expert somehwere in Mexico, and the Mexican government cannot shut him down, they can’t even find him....yet.

The sites name is “blogDelNarco.com” Video footage of the violence is posted there to show the world what is happening.

So the beheadings are more than “reports” They are filmed by the cartels, and if to want to see beheadings of 7 men , it is here, so its more than a “report.”Its a fact.

Yes, Arizonans have reason to be afraid, and Joe is in the know.So are the feds, and they choose to import the violence to Arizona to suit their own ends in destroying Arizona as a red state. This is what this is about.The destabilization of the entire Southwest
, and the esatblishment of an Obama multi racial, multi ethnic Utopia that Arizonans DO NOT WANT, BECAUSE OF THE DANGER. This does not make Arizonans into “racists.”

This is demographic warfare by the Federal government against the State of Arizona.It is not only unconstitutional, but treasonous to invite such violence into our country under the guise of minority rights. Thats why we have an Immigration Act.

Obama had better start genuinely enforcing the law, had better seal the borders, or he will have more trouble than he could ever possibly imagine. Once the drug cartels gain critical mass in arizona, and the honeymoon Obamas secret community organizer operatives have negotiated with them is over, there will be war between Arizona and the cartels.

Thats the problem folks.And it would seem that war between the state and mexican drug cartels in Arizona is what Obama wants.Its not Rocket science. And Obama will be rooting for the minority/ethnic drug cartels to win.

Everyone should have that picture by now.it is the measure on just how far Obama will go to ruin America and hand it over to Mexican thugs who have not a patriotic bone in their bodies.They will be the brown shirts of the liberal fascists now in office.

We can stop this , if we can understand exactly what its about, using truth, exposure, and ridicule.And if that doesn’t work, we have the ballot box, and if that doesn’t work, we have the example of our ancestors.

Would it have been more palatable for you if the officers gunned down were local police?

No, it would have been more palatable if illegal aliens were being gunned down, especially drug cartel gang members. The whole Waco debacle was a cluster. I have a strong hunch that those who bad mouth cops doing their jobs also bad mouth the national guard at Kent State 40 years ago.

Well you're not describing me, but when cops occasionally screw up, they are not above criticism, accountability, and most importantly, they are NOT ABOVE THE LAW.

“Organize an attack on a US Naval vessel killing over a dozen US Sailors, and the DOJ doesn’t have time to worry about prosecuting you, but if you have the audacity to try to enforce the laws and curtail illegal immigration, and obama’s gestapo will come at you like a spider monkey.”

I am afraid Joe will disappear and be found dead in the desert. Of course the likely villiann is the cartel drug lords who have put a price on his head.

alternately, given that putin is said to have suggested to china that they dump US agency debt en masse prior to this event, it may also relate to something some nationstate (probably russia?) did.

I still find the 50B or whatever in treasury bonds carried by 2 japanese nationals into switzerland a fascinating issue. if they were fake, why where the men released? Clearly the avaiable info on this incident (which isn’t a lot) doesn’t add up.

I am a long time lurker here and a resident of Maricopa county and I remember that this particular lawsuit started under the Bush administration, not that it really matters.

I’d love to see Obama and his entire administration (Holder, Axelrod, Emmanuel, Pelosi, Reid, et al.) carted off to the outdoor tent city portion of Maricopa’s prison system! They could rename it Obamaville and allow people to take pictures of all of them in their pink undies for a couple bucks a pop.

I guarantee Maricopa County could then forego ALL Federal funding for ANY of their operations. Just think of all the local tax revenue from restaurants and hotels to accommodate all the folks that would visit then!

speaking of those federal funds - one thing I noticed in the DOJ filing is that they are basically whining that this particular sheriff’s dept. isn’t cooperative ENOUGH when compared with other agencies that receive federal funds (which I would bet almost ALL do nowadays especially if like in Maricopa they deal with the JTTF and FBI. It would seem that finding a way to reject federal funding would be a benefit for ALL departments - especially if the DOJ believes that accepting federal funds puts a dept. under their thumb...

If I read the article right yesterday I believe the lead attorney on this case out of the civil rights division of the DOJ is the very same man who decided to DROP the case against the Black Panthers because he couldn’t find anything wrong with what they did...

This is clearly a POLITICAL play and it has nothing to do with actual civil rights abuses. Arizona has bravely stuck their necks out due to necessity and Obama and his cronies are trying everything they can to behead them — even going to the UN to gain leverage (does he really think Americans would ALLOW UN troops within our country?) I don’t know how much more of these actions our country can withstand.

Thank God November is almost here — I pray to God we take at least the House back so we can block some of the agenda and hopefully get other portions repealed... That and if we do get back the House and more seats in the senate then I would hope that impeachment proceedings against Obama would begin 10 minutes after the new Congress is sworn in. (Hey a girl can still dream, right???)

I agree with you completely. You’re absolutely right about Obama’s decision to return Churchill’s bust. It all has to do with having a score to settle with Britain (and in his mind all of “the West”) for happenings in Kenya... Obama definitely has allegiances, but they are NOT allegiances to this country, our Constitution, or any people other than those that either see him as a true Messiah, or are depraved enough to see through him, but think there will be some reward for them for standing beside him...

I hope this particular battle the DOJ has chosen to start gets the attention it deserves — perhaps it can wake up others if it does. The audacity of the DOJ lawyer filing this lawsuit vs. dropping the CLEAR-CUT DECIDED case against the Black Panthers is outrageous. I think the lawyers for Maricopa should throw everything possible at the DOJ. I’ll be praying for them — especially for everyone’s safety down there. I definitely wouldn’t put it past this administration to put the “President’s” Citizen Assassination Executive Order to use.

I am also wondering whether the fact that a Federal Judge a while back declared that a county sheriff was the highest official in any said county would give Maricopa any more leverage in this case.

This all just makes me sick...

(Hope you are doing well, Candor.)

I join in your prayers for the safety of all...

I’m worried about a WACO staged by “soldiers” with light blue helmets on since Obama seems to think the UN is going to help him in this battle (and frankly, with his goal of destroying the Constitution and our sovereignty they might be willing to ‘help’ us ‘get our act together’ and take care of those ‘fatal flaws’ Obama sees in our Constitution). He could really top Clinton and Reno by getting the UN involved — he’d LOVE to see that (’citizen of the world’ as he believes he is).

The drug cartels that use Arizona as a passageway are probably salivating at an opportunity to gain more ground as well... I know Mexico’s President is apparently trying to “crack down” on these cartels, but I don’t think it’s going too well. I hate to say it, but I’d hazard a guess that it’s only one or two cartels they are really going after (probably to make way for whichever cartel is kicking more money back to the Federales). If Obama does anything in Maricopa County like what happened in Waco I think they’ll be dealing with a much larger problem in the long run than some supposedly “rogue” sheriff. The gunmen fighting on the border might just decide to “join the fun”.

Perhaps that’s the point though. Obama might be making Arizona into the ‘flashpoint’ in his plan for destruction. They need violence to press their point, and gain more control. To justify drastic action on their part...

OK, that’s enough speculation for now! LOL I keep hoping I’m wrong. Hoping that Obama isn’t as evil as I suspect, but day after day all that happens is that he and his minions prove more and more that they really are that insane.

God bless all patriots fighting to keep the spirit of freedom within America alive...

Which is exactly why The Founders required the President to be a natural-born citizen.

Very large shifts of private capital are happening, and the Japanese men carrying 50B inn T bills is interesting, simply because in Sowtzerland they could have sold them at a discount and taken secure funds backed by Gold bullion.

I see it as the beginning of a retreat fromo the US dollar. Large institutions are hedging against a possible crash of the USD .The qestion is, “ IS IT A PLANNED CRASH?”

>Let’s not mince words. Anyone who doesn’t believe, in the face of overwhelming evidence and testimony, that Koresh wasn’t molesting children really needs to pull his head out of the sand for awhile.

Look, I’ve got NOTHING but at best third-hand information on Koresh himself; if I was on a jury and hearing testimonies that would be different (hearing first-hand accounts).

But your insistence on condoning the raid because of his guilt in an unrelated area of the law is, frankly, disturbing. (As I recall the raid had NOTHING to do with sex; and EVERYTHING to do with taxes/firearms.) Koresh was also known to go into town very-nearly daily, it makes a WHOLE lot more sense to have a warrant and a few officers and snap him up there rather than expend all the manpower, equipment, money, and time in a standoff/raid situation.

Your non-answer of a reply reply on the question of some law-breaking invalidating legal protections leads to the question: do you condone no-knock warrants?

>I’m not saying that the raid was conducted properly (although I do believe the fire was started by Koresh’s groupies), but he was a scumbag criminal.

The problem with labels like ‘scumbag’ and ‘criminal’ is that they can so easily be applied to someone who is innocent of any wrongdoing.
Let me give you an example; my state, New Mexico, has the following in its State Constitution:
Article II, Sec. 6. [Right to bear arms.]
No law shall abridge the right of the citizen to keep and bear arms for security and
defense, for lawful hunting and recreational use and for other lawful purposes, but
nothing herein shall be held to permit the carrying of concealed weapons. No
municipality or county shall regulate, in any way, an incident of the right to keep
and bear arms.

It’s very simple: the state cannot legitimately pass laws restricting my right to carry weapons openly for self defense; neither can cities or counties punish/persecute me for choosing to do so (i.e. charging me with “disturbing the peace” because I was open-carrying).

Now, there also exists a State Statute which reads as follows:
30-7-2.4. Unlawful carrying of a firearm on university premises; notice; penalty.
A. Unlawful carrying of a firearm on university premises consists of carrying a firearm on university premises except by:
(1) a peace officer;
(2) university security personnel;
(3) a student, instructor or other university-authorized personnel who are engaged in army, navy, marine corps or air force reserve officer training corps programs or a state-authorized hunter safety training program;
(4) a person conducting or participating in a university-approved program, class or other activity involving the carrying of a firearm; or
(5) a person older than nineteen years of age on university premises in a private automobile or other private means of conveyance, for lawful protection of the person’s or another’s person or property.

B. A university shall conspicuously post notices on university premises that state that it is unlawful to carry a firearm on university premises.

C. As used in this section:
(1) “university” means a baccalaureate degree-granting post-secondary educational institution, a community college, a branch community college, a technical-vocational institute and an area vocational school; and
(2) “university premises” means:
—(a) the buildings and grounds of a university, including playing fields and parking areas of a university, in or on which university or university-related activities are conducted; or
—(b) any other public buildings or grounds, including playing fields and parking areas that are not university property, in or on which university-related and sanctioned activities are performed.

D. Whoever commits unlawful carrying of a firearm on university premises is guilty of a petty misdemeanor.

So, now let’s say that I went to class [New Mexico State University] open-carrying.

Would I be a criminal? {You could claim that I was for having violated a State Law, despite that it is Constitutionally invalid.}
Would I be a scumbag, for deliberately and flippantly defying that law? {Or perhaps you could say I’m a scumbag *because* I’m a criminal.}
