Interesting. I know there are cases where city/state/federal employees have been terminated for saying
racist things even outside the workplace. And, those terminations have been upheld in court, BUT, Islam is not a race. It's a religion. If you enjoy freedom of religion, then you also enjoy freedom to openly criticize, mock and ridicule religion - Islam, or any religion.
I don't see how the state of NJ could infringe on this man's 1A protections, but I'm not a 1A or employment law authority. It's an interesting question.

Another interesting question would be if he would have been fired for burning the U.S. flag.

In their statement they called him “an at-will employee.” If it’s true, his options might be somewhat limited.

If this guy gets a multi million dollar settlement, I am going out the next day and burn several Korans!
To: OldDeckHand
He has been reported as an “at will" employee which would mean that the employer doesn't need a reason to terminate him. We need someone who has legal knowledge of NJ employment law and NJ transit employment provisions to look at this situation.

IMO the guy is a hero, I would gladly contribute to a fund to sue the city on his behalf.

I hope he sues.If he had burned a US flag (or a Bible) he probably would have gotten a raise.

Had this man’s name been made public before? I had not seen it. A courageous man, and a courageous Muslim-American lawyer would be wise to take up his cause for a wrongful firing lawsuit.
Any number of Jewish and Christian lawyers would step forward to defend a Muslim harmed by anti-Muslim bigotry on the job, were that Muslim to have gone to a pro-Mosque rally and burnt am American flag and a Bible.

Wonder when I will be fired for disrespecting the unholy book? Read the story, freep the poll! Thanks to Munz for the heads up!
"Do you think Derek Fenton deserved to be fired?"
FREEP THIS POLL ***PING!*** FRmail me if you want to be added or removed from the Fearless Poll-Freeping Freepers Ping list. And be sure to ping me to any polls that need Freepin', if I miss them. (looks like a medium volume list) (gordongekko909, founder of the pinglist, stays on the list until his ghost signs up for the list)

BWAHAHAHAHAHAHA!!!! Oh man, pardon me. Whew! Hoo, ah ha. I live in New Jersey. Somehow the words ‘’ethics’’ and New Jersey together is too much. NJ Transit is a freakin’ monopoly, service sucks and the fares are constantly going up. (thank the unions) If the guy had burnt a Bible they’d have made him a vice president of operations or something. “Ethics’’. That’s rich.
