They discriminate between those who can read, write and count and those who can't. As you know, Western Civilization sprung fully formed from the forehead of some minor deity and the attempt to find those who can function in that civilization are just "discriminatory" acts of The Man.
I see... the exam MUST be biased because blacks and hispanics fail it in a greater percentage than whites. Why do I suspect that if the exam was written in spanish ebonics, nothing would change?

The judge needs to learn to discriminate between “discrimination” (an essential survival skill, for any species); and “unfair discrimination”.

That’s the real issue we face as a people. Changing elected politicians is easy enough. Downsizing the bureaucracy and removing its stranglehold over American life is quite another.
