In an order signed Monday, Southern District Judge Harold Baer Jr. ordered two firms serving as co-lead counsel in a securities class action against Gildan Activewear—Labaton Sucharow and Robbins Geller Rudman & Dowd—to "make every effort" to assign at least one minority and one woman to the case.
"This proposed class includes thousands of participants, both male and female, arguably from diverse backgrounds, and it is therefore important to all concerned that there is evidence of diversity, in terms of race and gender, in the class counsel I appoint," the judge wrote in In re Gildan Activewear Inc. Securities Litigation, 08 Civ. 5048.
Labaton and Robbins Geller did not return calls for comment.
Judge Baer appointed the plaintiffs firms to lead the case two years ago, and in August they submitted an unopposed motion for a preliminary settlement. (The settlement agreement was made in conjunction with two other proceedings in Canada.) What remains are largely administrative functions and a hearing for preliminary approval of the settlement.
This is not the first time Judge Baer has made a point of supporting diversity from the bench. In his Gildan order, he referenced a decision he made three years ago in In re JPMorgan Chase Cash Balance Litigation, 242 F.R.D. 265, 277 (S.D.N.Y 2007), in which he required co-lead counsel to assign one woman and one minority with requisite experience to the case.
The assumption is that a lawyer cannot represent someone who is sexually or racially diverse. How many criminal appeals would that open the floodgates to?
And when this judge is laying on a Hospital Gurney the doctors should tell him that they’re looking for a ‘minority’ doctor to treat him.
Southern District Judge Harold Baer Jr needs to be removed from the bench for being a racist and sexist bigot, pure and simple.

Just wait until the new finance law goes into effect which forces Fortune 500 companies and other financial firms to diversify their hiring. Oh, and Treasury, SEC, etc. are required to do so as well.

That is the worst part of this! The freaking case is pretty much settled,all that is left is a hearing and for lawyers to divide up the loot. The worthless bastard just ordered that two affirmative action flunkies have to get a chunk of the loot that they did nothing to earn!

If we can not get this sort of lunacy off the bench, at every level, we done as a nation of laws.
