RIVERSIDE, Calif. -- A federal judge has issued a worldwide injunction stopping enforcement of the "don't ask, don't tell" policy, ending the military's 17-year-old ban on openly gay troops.
U.S. District Judge Virginia Phillips' landmark ruling issued Tuesday was widely cheered by gay rights organizations that credited her with getting accomplished what President Obama and Washington politics could not.

Why are they in such a rush. The Pentagon is doing an indeph study on this and will be done in December. Heck they even invited the “boyfriend” and “girlfriend” of gay and lesbians to the Pentagon for a chat about what issues they have that the military is not providing. The active duty member did not attend. It seems to me that judges are doing this but it is stupid until the Pentagon gets it act together. (This story was in the latest Navy Times). I am in the Navy but retire in June 2011 after 24 years!!! I don't know what will become of this but it needs to be done. Don't ask, Don't tell is adequate. VERY FEW gays are discharged and they are only kicked out if they are found out, but it is typically something that the “gay” did that was stupid. Everyone in the military I know just want this issue over (because it is not needed and just needs to go away).

Yes. Separation of powers. The military is clearly in the domain of the Executive Branch. The President has Commander-In-Chief powers that the Supreme Court cannot override.
