The Video that Judge Bermudez Denied the Victims Shows the Lies about 3/11

Unease and disagreement among the official experts when DNT was found in the samples coming from the 3/11 attack. The tapes [recorded by the cameras Judge] Bermudez ordered to install, and that were denied to the victims during three years, come now to the light. [Newspaper] EL MUNDO publishes their content, which refutes the sentence.

Shortly before the trial of the 3/11 case began, the president of the Court, [Judge] Javier Gomez Bermudez, ordered to perform the analyses of the explosives used in the massacre, since [investigative] judge Juan del Olmo [who prepared the case] had refused to do so. For that task, he designated eight experts (four officials and four proposed by the private accusations and defence attorneys).

Cameras were set up in order to record 24 hours a day everything it happened in the laboratory and the court’s secretary would assess the operation of the recording system. Well, finally, EL MUNDO has gained access to those tapes.

The astonishment and the annoyance of the experts when dinitro toluene , DNT, was found, since this substance it is not a component of the explosive Goma-2 ECO but of Titadyn, was already knew by the account that regarding this moment had told the independent experts, but now acquire further strength with images.

The video exhibits the unease experienced by the experts when discovering in the few samples left from the attack DNT, a hydrocarbon unrelated to the Goma-2 ECO, the explosive the official version insists that it was what exploded in the trains and that it was sourced from Conchita Mine, but a component of Titadyn, used habitually by ETA.

It is the result thrown by the analyses on an electrical coil and several metallic pieces picked up by the EDU team in the train that exploded in El Pozo, known as sample M-6-12-d.

“Ugh… dinitrotoluene!”, are the words of police expert Andres de la Rosa when DNT appeared in the test that he was performing. Independent technician Carlos Romero asks then: " What? What has happened? ". The police expert, head of the task group, Alfonso Vega, recognizes that "in this case, it can exist another explosive load”.

According to what it tells [the newspaper] EL MUNDO, the police acted as if they could not believe what it was happening, because the finding proves that the thesis of the Office of the Public Prosecutor and the General Information Unit of the National Police was in doubt. In the trains did not explode dynamite from Conchita Mine. Next, De la Rosa rises and notifies the news, which creates a great commotion. Very worried are seen the experts of the Civil Guard, lieutenants Carlos Atoche and Jose Luis Ferrando. Later, it appears the technician appointed by the Association for Aiding of the 3/11 Victims, Antonio Iglesias, together with Alfonso Vega who asks: "It yields DNT? “. "" , answers Romero.

Antonio Vega performs another analysis to be sure. According to EL MUNDO, the most worried are the technicians of the Civil Guard, constantly moving and trimming their hair, overwhelmed. The head of the task group insists:

- "This is necessary to be confirmed… this is necessary to be confirmed via HPLC [High Performance Liquid Chromatography] eh? This sample is necessary to be extracted in HPLC again, perhaps because in this case… there is another explosive load. And I begin I to… doubt about the TEDAX [National Police EDU team]. Y a cagarme en la madre que los ha parido".

The technician of the Military institution Carlos Atoche says with regret: "We are going to become famous persons, you’ll see".

After DNT was discovered in the samples, as it advanced LD in exclusive, the cameras stopped recording. There was a blackout [read it below].

The experts refuted in the video the argument under which the sentence is sustained But there is more. And it is that the entire sentence is sustained in another one of the components that appear in the analyses: the dibutil ftalat. The panel of judges maintained in their ruling that this substance is "a component of Goma-2 ECO and not of Titadyn" and they add that "an exclusive component of that type of plastic dynamite is in a significant percentage - more of the 1%-, in all" the explosion scenes. For that reason they conclude that the explosive used in the massacre is the Goma-2 ECO, the one that removed Asturian [miner] Emilio Suarez-Trashorras and then gave to the Islamists of Lavapies.

This is what the expert of the Civil Guard Carlos Atoche and the head it of the group, Alfonso Vega told in their testimonies before the court. But not during analyses. The cameras recorded the following conversation:

- Alfonso Vega: Look, we have dibutil ftalat here. But also, as I told you… ftalat… I mean that the issue regarding the ftalat…

- Carlos Atoche: You cannot attribute it to an explosive.

- A.V.: That’s it, that’s it … is like a generic contamination.

- C.A: From the world-wide world…

- A.V.: From the world-wide world, yeah…

- A.C.: That is, this cannot be assimilated… Although we know that the explosives have ftalat, we could not say that this ftalat comes from the explosive, practically, although it were present in both of them simultaneously, because it is that…

- Antonio Iglesias: It is not specific.

- A.C.: They are ubiquitous. They are everywhere.

- A.V.: Even knowing that they have it…

- A.C. (While showing a glass jar containing bags with samples): You have plastics here? Then you are already screwed up, since it is a substance to treat them.

Atoche expert, in the previous dialogue, admits in an implicit way that keeping the samples in bags is already a sufficient reason to cause the appearance of that component in the analyses , not allowing the identification of the kind of dynamite.

But Carlos Atoche lay or at least contradicted himself in the trial. When the Chief Prosecutor of the National High Court, Javier Zaragoza, asked him for that reason: "Does dibutil ftalat appear in the rests of exploded Tytadine? “, Atoche answered: "Dibutil ftalat is a component that does not belong to the Titadyn. It only is in the Goma-2 ECO”.

The court held to that argument in spite of the protests of the independent experts, who pointed out that dibutil ftalat is a substance that can be found everywhere like in paintings, plastics, etc; even after the viewing of the tapes in which Atoche and Vega recognized that.

Moreover, Vega himself testifying in the case that is being carried out in the Plaza de Castilla [provincial] courts against who was the administrative chief of the TEDAX [EDU during 3/11], Juan Jesus Sanchez-Manzano, recognized recently that this substance is not a component of the explosives.

The court, and particularly Judge Gomez-Bermudez, knew the content of the tapes, although the panel of three judges did not want to show them to the public during the trial and denied them to the victims. Now, three years later, Judge Bermudez agreed to hand them over to the Association for Aiding of the 3/11 Victims. During an interview in esRadio, Antonio Iglesias acknowledged that “it is not normal" the astonishment shown by the police before the finding and emphasized the harsh remark by Antonio Vega against the TEDAX. He felt “deceived”, he said. Iglesias also criticized that the next day, Vega came with the hypothesis of the contamination in factory in order to "weaken the evidence that we all had just observed". "He slept on it or someone made him slept on it".

Fact confirmed by the forensic experts
The cameras of Bermudez stopped recording during a blackout after the finding of DNT in a 3/11 scene sample.

When the court of the 3/11 case, presided by Judge Gomez-Bermudez, decided to order, three years after the massacre, a complete analysis of the samples recovered from the trains, he ordered to set cameras in the laboratory of the Scientific Police with the purpose of recording 24 hours a day everything that happened in this laboratory. According to the data to which it has had access Libertad Digital, the recording of the cameras was interrupted temporarily due to "a blackout" a few hours after the surprise finding in one of the samples of dinitro toluene [DNT], which is not a component of Goma2-ECO.

The idea of recording everything that happened in the laboratory was a personal will of Judge Gomez-Bermudez. In three years nothing had been known of the explosives used in the massacre, reason why the magistrate bet with success in absolute transparency. He had the double objective of proving that no one had been able to manipulate the samples from the moment the forensic tests began and for leaving record of the incidences happened during the development of those tests. The court’s secretary was in charge of assessing the correct operation of the recording system.

In the forensic tests participated 4 experts appointed by the Ministry of Interior (2 from the Police and 2 from the Civil Guard) and 4 others appointed by the private accusations and defense attorneys. […] The skill was directed by one of the members of the laboratory of the Scientific Police, Alfonso Vega, later decorated by the government.

The tests were anything but placid. In fact, throughout those weeks of intense work, moments of enormous tension were lived, especially when the tests began to throw surprising results, like the appearance of dinitro toluene (DNT) or nitro glycerin, which are not components of Goma2-ECO, the explosive that according to the official version had been used in the massacre. Those moments of tension, which have already been described in a chronicle by the newspaper El MUNDO, were shaped in confrontations of great toughness, that were gathered by the cameras, and that throw serious doubts on the objectivity of the experts appointed by the Ministry of Interior.

Once the trial was finished, two of the parts which participated in the trial (the defense of Basel Ghalyoun and the AVT) asked the court presided by Judge Gomez-Bermudez a copy of the recording of the forensic tests. Surprising, the court rejected the request of delivery of those copies.

Asked for the reason […] Judge Gomez-Bermudez argued that the recording of the forensic tests is not demanded by law, but was something that the court decided by its own will, and that therefore did not exist a legal obligation either to give this copy to the parts that participated in the trial. Consequently, the defenses and private accusations will not have the tapes where they were reflected the hard confrontations that took place among the experts.

But there are some other important aspects during the course of those forensic tests that are also related to those tapes that the court which judged the 3/11 case has rejected to hand over. In particular, according to the data to which it has had access Libertad Digital, the recording of the cameras was interrupted temporarily “due to a blackout" a few hours after the surprise finding in one of the samples of dinitro toluene, which is not a component of Goma2-ECO. Precisely, on February 6 experts discovered, surprisingly, that in one of the samples given to be analyzed, the M-6-12 sample, had appeared dinitro toluene, which it is not a component of the explosive officially used in the trains. When the experts arrived at their working place the following morning, the secretary of the court informed them that, apparently, the previous day "a blackout had taken place" and that the cameras destined to guarantee that the samples were not manipulated, stopped recording around 8:00 P.M.

Judge Gomez-Bermudez has been decorated for the third time in the last two years by the Minister of Interior Rubalcaba. This decoration does not come alone, its awarding is related to an increase in 10% of his salary.

Tanuki, you asked me once what was all this for.

Those videos were told to be lost. Only the push of the Association of Aiding of 3/11 Victims, and its perseverance in prosecuting Sanchez-Manzano, has allowed the judge of the case (from the Provincial courts, not so hardly controlled as the National High court) to ask for them, and threaten police and judicial civil servants with sanctions if they were not handed over to the court.

I think they are following the correct way of proceeding in such a case: saving the more evidence as possible and questioning witnesses, experts and defendants before a judge, so their testimony will have legal value, now and forever.

Nailing down such things leaves less space to maneouver when disinformation campaigns are set. In fact, the official side, leaving aside the issue of the decorations which is plainly an insult and a mafia-style threat to the democratic Spaniards, has not moved in the last months. They received the broadcasting of the videos simply labelling the channels that did so as “Fascists”.

You’re right; the most important aspect of these tapes is that they’re available at all. Bermudez’ ‘investigation’ has just gone from simple obfuscation to outright cover-up. There’s no way the ‘responsible authorities’ can hide their own culpability; by manipulating outcomes, they are as guilty of the consequences as the bombers themselves. Assuming, of course, that they had nothing to do with the actual act and that is now an open question.

The 3-11 families need to be applauded for their achievement. This one revelation will reverberate throughout the governmental system. I hope one day they will have all the answers they seek and that this will bring them some solace.

It took me several readings to figure out that "ftalat" was "Phthalate."

I never heard of DNT before. Learn something new every day.

Dibutyl phthalate (DBP) is a commonly used plasticizer. It is also used as an additive to adhesives or printing inks. It is soluble in various organic solvents, e.g. in alcohol, ether and benzene. DBP is also used as an ectoparasiticide.

We also had the boric acid case, a substance only related to the 3/11 case when some high rank police officers tried to avoid a reference to ETA in a forensic report. They were found guilty... of an administrative fault, and later promoted by the Interior Minister.
