Senate advances bill to overhaul food safety
Washington Post ^ | November 18, 2010 | Lyndsey Layton

The Senate moved forward Wednesday on long-awaited legislation that would overhaul the nation's food safety system, grant new powers to the Food and Drug Administration and make farmers and processors responsible for preventing food-borne illness.

Sen. Jon Tester (D-Mont.), himself a farmer, negotiated language into the bill late Wednesday to exempt small farmers who have annual sales of less than $500,000 and sell the majority of their product directly to consumers, restaurants and retailers in their state or nearby.

“The FDA has said it does not have enough resources to conduct regular inspections.”

...translation....bigger budget requests...hire more people...bigger government.

Thank you for posting. I just wanted something to post to get FReepers moving to see what, if anything. can be done. Looks like a lost cause in the Senate. If I am correct, it passed the House and we may need to fire up the House to kill reconciliation.

Like we had them all fired up to kill Obamacare? That worked out well, didn’t it?

Well, hopefully the house Republicans won’t be quite as eager to impose their will on us as the Democrats were.

From looking at the legislative actions, I believe that it hasn't made it to the House yet — there is listed a related house bill, H.R.1332, the "Safe FEAST Act", but it hasn't moved out of committee.

Now's the time to fight this in the Senate.

” I believe that it hasn’t made it to the House yet “

The House version of this bill - HR 3808, if I remember correctly - passed in late July....

And I wouldn’t put much faith in ‘reconciliation’ - if Porkulus and Obamacare are any guide, this will come out of Conference Committee a *worse* bill than was passed by either house, incorporating the worst aspects of both, and stripping away any protections for we-the-people....

If that is the case and cloture was invoked with 74 votes - we are sooooo screwed.

Again

Yup - and icing on the cake — Conference Committee reports cannot be filibustered or amended - it’s a straight up-or-down, simple-majority vote...

Cloture was our last chance to kill this thing....

HR 3808 is the bill related to notarizations which expands the legal recognition of "electronic notarization".

We need to hold house Republicans’ feet to the fire...

They deserve NO latitude on ANY issue...and what is more, they must rehabilitate the image voters have of ‘Republicans’ in Congress and Conservatism, nationally.

I have never understood why/how this could confuse anyone. The Conservative platform is SO direct, unambiguous and consistent….. how is it possible that our ‘representatives’ stray so far from the message?

If the new guys feel they have to suffer for the sins of others, well… so be it.

These guys CANNOT put a foot wrong… too much is at stake and the meter is running. Alert, cautious and angry voters are by now, hyper-sensitized to Congressmen who conduct themselves as if they are not accountable.

We have a situation in this country now, where the word ‘taxpayer’ is equivalent to ‘victim’.

No government of ANY stripe should push citizens to the place we now find ourselves in this country. It is a dangerous and volatile socio/political environment and needlessly so. A great deal of the alienation and rancor has been ‘self-induced’ and totally gratuitous. Politicians (Liberals especially) have willfully and irresponsibly toyed with the enviable social stability of America. FIE!!!! .

Conservatives have NEVER challenged civil or human rights in this country and resent charges that we do. We recognize these rights AND we recognize HARD-EARNED rights. However, groundless and repeated Liberal accusations have created a miasmic political atmosphere, where little more is needed in motivating honest citizens to go against their own conscience in a desperate effort to retain and exercise their HARD-EARNED rights!! ENOUGH!!

I am by no means wealthy, but Tea Party candidates and that organization will receive donations from me.

The exemption is worthless!

They base it on SALES, not on PROFITS, and I believe farmers have a small profit margin, so this would apply to just an extremely small mom/pop operation.

Worse than that, if even THIS small time operation was to do something politically incorrect, like selling raw milk, or grass-fed lard, (or just selling in the wrong 'turf') and they caught the ire of this administration, they would STILL lose their exemption and be bankrupted by the FDA!
Sen. Jon Tester (D-Mont.), himself a farmer, negotiated language into the bill late Wednesday to exempt small farmers who have annual sales of less than $500,000 ...

If the FDA had reason to believe a small farmer was producing unsafe food, it could revoke the exemption for that farmer, according to the provision.
