A 30 year old Youngstown man facing 13 years in prison on a plea agreement has escaped after being allowed 3 weeks at home prior to his sentence commencing.
Lexter Williams and 3 others, burst into a Livingston St home on January 22, 2009, demanding money and valuables from the occupants. While the others held the men at gunpoint, Williams, who was also armed, took a female into the basement and raped her.
Williams was charged with 5 counts of Aggravated Robbery, 4 counts of Kidnapping, and 1 count each of Rape and Having Weapons While Under Disability, which could have gotten him an 86 year prison term.
In a plea agreement, Williams was to serve 2 consecutive 10 year terms and a 13 year consecutive gun specification term. The Rape was reduced to Gross Sexual Imposition.
Perhaps the most striking part of the plea agreement was that the prosecutor and the judge agreed to allow Williams 3 weeks at home before formally being sentenced ...
A house arrest monitor was strapped to Williams' ankle and he was to report to Community Corrections Association daily. He failed to report this past Thursday and it was later found that he had cut the ankle monitor off. His whereabouts are currently unknown.

The enemy of the powerful in an oligarchy isn’t the thug, murderer, or rapist. It’s the common citizen. The thug, murderer, or rapist is their ally in keeping the common citizen afraid and in line.
Even if the judge and prosecutor didn’t know this consciously, they knew it instinctively...
If he's not found, the prosecutor and the judge should each serve half of his sentence.
Were the victims White?
This insane leniency in keeping tabs on a dangerous crook is doubtless a sop to a liberal-Rat constituency.
On the upside, by going fugitive he has committed a subsequent felony. When he is recaptured, he will be tried for that, too. Hopefully with a sentence that will be consecutive and not concurrent (the usual freebie that judges give out).

At a wild guess, I’d say that given his extensive criminal weapons, the man was forbidden to possess or carry firearms.
In Ohio it means you are a convicted felon, on probation,parole or have a court order prohibiting you from possessing any firearms hence the disability.

I have never heard the term before either, but I have a guess. The Brady Bill provides that someone accused of various offenses, notably domestic violence, is prohibited from possession of firearms. Note - ACCUSED - but NOT convicted. This may be the rubber bumper on the soft tyranny, to call someone so accused but presumed innocent, legally ‘disabled’ from possessing firearms. It may be an umbrella term for all such restrictions.
I emphasize that this is mere speculation on my part. It is just as likely a reporter’s typo, or incorrect terminology. One of the pitfalls of the English common law system which we unfortunately inherited, is the ability of judges to pull laws and doctrines our from under their robes and call it wisdom and authority.
