Birther faces court martial for refusing deployment orders

A court martial proceeding against an 18-year Army veteran who refuses to deploy to Afghanistan will begin today at Fort Meade in Maryland.

According to The Associated Press, Lt. Col. Terrence Lakin disobeyed orders to report to a Kentucky base earlier this year because he doubts whether President Barack Obama was born in the United States and questions his eligibility to be president. Click here to view the charges.

I will be attending the scheduled Court Martial of LTC Terry Lakin on Tuesday, 14 Dec 2010 at Ft. Meade MD, to show my support for this brave man who is courageously standing up and risking all to live up to his oath to support and defend the U.S. Constitution, the prime directive to guide the actions and decisions of every commissioned military officer and patriot.

The oath for military officers is not to support and defend the President or any man, but to support and defend the Constitution the fundamental law put in place by the founders and framers to protect our unalienable rights against all enemies foreign and domestic. The Congress failed to do their duty.

The main stream media has failed to do its duty. The legal system and federal courts including the U.S. Supreme Court have failed to do their duty. We are supposed to be a nations of laws, not men. And no man in our system is to be above the law, not even a President.

These people and the institutions have been acting to protect one man, Obama, from being required to provide conclusive primary source, certified true and correct copies of the contemporaneous documents of his birth records and other records such as college admission records and travel and passport records to answer some simple questions about his early life and true legal identity.

A digital image on the internet of an alleged secondary source and summary document in the age of PhotoShop is proof of nothing. No one in the major media with independent expert document examiners has been even allowed to see the alleged piece of paper that image was allegedly made from.

These people and institutions are acting to protect a man, one man, Obama, who has held himself out to be above the law. They have not been acting to protect the U.S. Constitution which they should be defending. LTC Terry Lakin is doing his duty and standing up for his oath to the Constitution.

I will be there on Tuesday at Ft. Meade MD to support him in his fight.

Neal Puckett advises LTC La(k)in will plead guilty to some of the Article 92 violations

I hate it that he’s going to plead guilty to any of these.

Especially since if Puckett was worth his salt he’d be arguing that these charges are outside the scope of Article 92. But Puckett isn’t supposed to be trying to win this, or even trying to make sure things are done in a procedurally correct manner. He’s just supposed to get this over with, because there is no expectation of justice from the United States military.

That kills me to say that. There is no expectation of justice from the United States military.

As Kerchner says, the US military is on trial tomorrow, and it is almost certain that they will be found heinously guilty.

That’s a load of crap. When there are questions about the lawfulness of the orders you obey the orders while initiating an inquiry regarding the lawfulness. Lakin only disobeyed orders when it was obvious to him that the United States military was never going to actually investigate the lawfulness of the orders. At that point he was in no-man’s-land just as if he was left stranded in the middle of the desert on his own. The United States military ABSOLUTELY AND UTTERLY FAILED THEIR DUTY AND FAILED AN HONORABLE MAN.

It was only when Lakin knew he was on his own (because the entire military structure was derelict in their duties) that Lakin disobeyed orders. Until then he was using the procedures he was supposed to use. When the military abandoned him he had no choice but to use his own discretion and conscience regarding the lawfulness of the orders - just as a person sent into enemy territory with no orders of engagement is forced to make difficult decisions.

I just got done watching “Valkyrie” for the first time yesterday. The first part is the sound of the German military members swearing obedience and loyalty to the Fuhrer.

Lieutenant Colonel Terrance Lakin made a vow not to “Der Fuhrer” but to the United States Constitution.

And that Constitution (20th Amendment) says that if the President elect “fails to qualify” by Jan 20th, the VP elect is to “act as President until a President shall have qualified”.

The Hawaii DOH has confirmed in 3 different ways that the Factcheck COLB is a forgery, and has made a statutory admission that the BC they have for Obama is not legally valid because it was amended in 2006. There has not been a legal determination of EVEN how old Obama is. His age is legally undocumented at this point.

How could he have “qualified” when nobody can even legally state what age he is?

Obama may well not be qualified to be President. I happen to believe he's not. But the courts haven't found that to be the case as yet. Until that happens, the soldiers are obligated to follow his orders. (And please don't use the Fuhrer analogy. No one is arguing that Obama asked the guy to do something immoral like kill all Jews.)

If we are going to allow individual soldiers to determine in their own view whether or not the President is qualified to hold that position, then we have to excuse the behavior of any soldier who refused to follow orders because Bush was "selected" instead of elected.
