House GOP: Bills will have to cite Constitution
By: Richard E. Cohen December 17, 2010 06:35 PM EST
Fulfilling one of their most prominent campaign promises, House Republican leaders have unveiled a new rule to require that each bill filed in the House “cite its specific constitutional authority.”
And for those who may have skipped that constitutional law class, Republicans have organized four staff briefings prior to the Jan. 5 start of the 112th Congress to provide guidance on compliance with the new rule. The first session will be Monday at 1 p.m. in the Capitol Visitor Center.
GOP leaders have prepared a memo for all members of the new Congress and senior staff informing them that no bill may be introduced unless the sponsor has submitted for the Congressional Record a statement “citing as specifically as practicable the power or powers granted to Congress” to enact the measure. The memo included five examples of forms that sponsors could include with their legislation.
And the memo warned that any bill that is filed without the requisite “constitutional authority statement” will not be accepted by the House clerk and will be returned to the sponsor. Such a statement, House Republicans added in a Friday statement, “also demonstrates to the American people that we in Congress understand that we have an obligation under our founding document to stay within the role established therein for the legislative branch.”

I wonder if some of them will even understand the Constitution once it is explained to them.
Will there be any teeth behind this new requirement? If the 2010 elections were not clear enough to make this happen correctly, they will find that we still remember in 2012.
Zero and his Regime including Reid baby and witch Pelosi would be well advised to attend the Constitutional law classes.
Really....?
Ok...maybe it is a start, but can we have that apply to the amendments introduced too?
Good news!
Remember they are all lawyers....is it going to be a matter of understanding the Common Man’s Constitution or a matter of twisting it to fit the agenda.
“Remember they are all lawyers....is it going to be a matter of understanding the Common Man’s Constitution or a matter of twisting it to fit the agenda.”
Agreed, they want to confuse the law.
Let’s just hope they start with the Bill of Rights and understand those are guarantees we have thanks to the Founders.
Without it, this wouldn't be in the making with the GOP.
Sadly enough, the GOP is doing it just to save themselves.
The change is still good however.
Cue all the freepers saying:
“this isn’t good enough”
“They’ll never go through with it”
“they’re all scumbags”
Why can we not say:
“Great idea”
“thanks for respecting the constitution”
I have a feeling we have become as bad as DU with our RINO/Obama derangement syndrome.
save
I suppose it is a fair goodwill gesture, but I would it to have a little bit of sting to it so I suggest adding the following:
Any Member who willfully and knowingly offers any Amendment or Legislation that violates this rule, SHALL be immediately and permanently stripped of ALL committee Assignments for the duration of their current term of office.
Second Offense: EXPULSION
Wonderful.
think it will last a month?
"I think the "Good and Welfare Clause" pretty well covers everything. But then again it would take a team of lawyers to understand that clause too, so I just don't really worry about it too much."
The democrats would find a liberal unjust democrat judge who would rule it unconstitutional to be constitutional.
Pelosi: "Are you serious? Are you serious?"
Increasingly over the years the Federal Government’s only self-acknowledged limitation of power is whatever it can get away with, in defiance of the restraints of the Constitution. This will be refreshing. I hope the new House can implement and sustain this.
Appalling that such a rule has even become necessary!
But it has, hopefully it will mean more than Oboma’s “Transparency” promise.
