BOYNTON BEACH, Fla. -- A man who dressed up as Santa Claus was kicked out of a mall in Boynton Beach. Larry Lester said he wanted to spread some Christmas cheer.
Lester said he put on his Santa suit after doing some shopping at the Boynton Beach Mall Wednesday night. Mall security asked him to leave after receiving complaints from families in line to see the official Santa.

We’ve already seen what selling lemonade without gubbermint authorization will get you.

I’m sure mall management would be upset if an unauthorized Santa visits with the kids. They have things all set up to have the kids visit the “official” Santa.
And we all know it’s somewhat of a racket with them selling you the pictures of your kids visiting Santa. But the malls want things done in an orderly fashion. An unauthorized Santa on the premises messes with the business plan.
Hell he could have just been a TSA officer on break!!

That’s what I would be afraid of if I was mall management. The possibility of a lawsuit would be too great.

You see the problem.
There is so much regulated in our society. My daughter was told to take down the hood on her coat in a mall. I can’t take photos in the mall. There are people watching monitors behind closed doors to make sure we are good little citizens.
Are we reaching the tipping point?

Look at it from the Mall's point of view. They would have to ask him to leave EVEN IF THEY DIDN'T HAVE an "official" Santa.
Why? Because people will naturally think that a guy dressed as Santa in a mall is there with the Mall's sanction. Especially if the mall takes no action against him.
Now, let's suppose the unofficial Santa molests a child or in some other way acts in a way that will bring a lawsuit or criminal complaint. The mall will be targeted in the lawsuit.
This is why the mall's legal department will not want ANYBODY in the mall who is not a mall employee but who a customer might trustfully mistake as being a mall employee. It doesn't matter if the guy is dressed as Santa, a security guard, or a leprechaun. If the guy might plausibly be taken as somebody other than another customer, security will probably ask him to leave.
Look, this Santa took away money from the contracted mall Santa, the fake Santa didn’t have insurance and was not bonded.
