And then he named William Brennan who haunted us seemingly forever. Then Nixon named Blackmun, Ford named Stevens, and Bush named Souter.

With those appointments, who needs the Democrats? Although theirs are always goose stepping one hundred percent dependably communist, otherwise known as “moderates” in the press.

They will also have to change the rules for getting a nominee out of committee which requires that at least one member of the opposing party vote to bring the nominee to the full Senate. They know that liberal judges can do increase the damage by upholding their unconstitutional laws.

It doesn’t take that much intellectual fire power to say: “We’re the liberals on the supreme court. We can do whatever we want. We don’t care if it’s not in the Constitution. We think it’s a good idea and that’s that.”

That’s the essential argument of the left in every really bad decision they have made for the last 50 years.

It's almost unthinkable how much power has accrued to the state over various courts and administrations. Can a couple more liberals on the court have much impact? What aspect of my life will be affected by more government intrusion into areas already polluted by the state? Abortion? Gun ownership? Private property rights? Taxes? Borders?

If anything, I hold-out hope that Sotomeyer or Kagan might just blow-up in Obama's face and one or both of these appointments just might see the imbalance that has occurred and take the side of the little guy (or states) for a change. If they don't, I'm still screwed and all doesn't end well, anyway.

Somebody please tell me why Kennedy is called a “conservative”.

In a blatant piece of activist judging, he wrote the majority opinion that gave captured foreign terrorists habeas corpus rights. In a landmark eminent domain case, he voted to give some citizen’s house away to a developer on the grounds that it would produce more tax revenue. You could be more conservative than that and be in Obama’s cabinet.

This article is laughable. The only way the the lefties in the court can dominate is by being loud and obnoxious. They cannot hold a candle to Scalia and Roberts. Any normal person knows that kagan and the wise latina do not have the gravitas of Scalia, Roberts or Clarence Thomas.

The new congress can hold hearings on SCOTUS judges appointed during the last congress also. It is not outside the enumerated powers and will put political pressue on SCOTUS, specifically Obama appointees, and by extention Obama himself.

But the tenor of the debate has changed in recent months, now that President Obama's two appointees to the court, Sonia Sotomayor and Elena Kagan, have joined the fray and reenergized the liberal wing.

SCOTUS has become "The View". That's just wonderful.

Now realistically will anything like that happen? Really? Media pressure will prevent those of the same ilk as those who just voted for repeal of DADT from doing anything like you posit. There will never be a review of O's SCOTUS appointees.

That is a done deal and our side lost. There is not any way to take down a Justice from the SC. At least not realistically workable. Tell me if I am wrong, but I am not.

Last time I looked, the Dems still control the Senate where judicial hearings are held. With all due respect, I can’t imagine where you got that idea, how it would come to pass, or why anyone would undertake such hearings. Who would do it, the Republican minority? All appointments to federal courts are lifetime appointments.

Sandra Day O’Kennedy replaced Sandra Day O’Connor as the drama queen at the center of the SCOTUS. He IS the court as things stand. Best he should hang on until there is a real POTUS again. Next opportunity: replace Ruth Buzzi Ginsberg, Stephen Breyer and the Obamao appointments with people who have a copy of the constitution and the demonstrated ability to read and apply the text and recharge the other five seats when convenient with young tigers. The situation stinks now but could be worse. Make recess appointments as necessary to fill vacancies for a year at a time. There are still many capable and constitutionally literate lawyers who would be honored to serve a year at a time to restore the constitution. With a fully purged SCOTUS, the SCOTUS could solve most problems and do so perfectly consistently with the constitution. It is SCOTUS responsibility to erase those unconstitutional precedents (abortion, gay everything, money squandering on unconstitutional programs, eminent domain as in Kelo vs. New London, etc.) that SCOTUS and federal courts created and THEN to lay down a very firm and well-established line on 10th Amendment jurisprudence to put an end to the legislative and regulatory depredations against the constitution. Decredential law schools and bar examining committees on admission to practice which refuse to comply
