When Sotomayor was appointed, some defendants' rights advocates, including Kirshbaum, speculated that she might take a hard line on prisoner appeals.

He said she's adopting a much different approach. "There seems to be real feeling behind these opinions," he said. "They give the criminal defendant's perspective on these issues."

So, when will Mr. Souter be accusing HER of "lying" in order to get a supreme court appointment (like he did with Alito and Roberts)?

Sotomayor owes her appointment to a constitutionally unqualified President, but I applaud her public dissent to decisions on refusal to grant certiorari.

I for one would certainly have liked to read similar dissents from Scalia and Thomas on the court’s refusal to hear cases on Obama’s eligibility. Instead SCOTUS cloaks its refusal to act on urgent matters in inscrutable silence.

The Supreme Court cannot hear every single case presented to it. The correct decision some, if not most of the time, is to let stand the lower court’s decision. Sotomayor wants to be the sole decider of such things.

Even Moses had to appoint “lower” Judges to hear less important matters and make decisions. He was persuaded to do this by his father-in-law.

What are she and Kagan doing on the Court in the first place? It’s becoming obvious neither can rule on most of the cases heard.

They both need to step down.

That was precisely the reaction I had upon reading the summary. What is different about this one, aside from her inexperience and incomptence, is her consumate skill in NOT answering direct questions --- sort of like Charlie Rangell --- and impatient about changing character of our country through judicial activism. She figures the legislature will back her up. Except for one thing.

Overeaching is always the demise of the pathological controller with god-complexes. The Great Uniter is a good example, as well as the leadership in the current House.

Overeach and pay the consequences; likely being shunned by the majority of the justices forever. Many of us thought she does not have the competence skills and experience to do the job, and her gauche behavior simply confirms her total lack of judgement and of the plain elementary rudiments of social ettiquette. Newbies to any new group simply do NOT try to take over the conversation before a discreet period of pretending that they are social animals --- not neurotic trailer-trash teenagers in adult bodies.
