The case of the 14-year-old media call "El Ponchis", who allegedly worked as an assassin for a Mexican drug cartel, illustrates the complexities spawned by an unsecured. Ironically despite allegations he committed brutal crimes, the teen faces a light sentence if hes convicted in Mexico.
The accused killer also faced issues about his citizenshiphe claimed to have been born in the U.S. but there were enough questions about his status that officials in both countries were trying to figure things out. This is a common problem, one that led to the Avena ruling President Barack Obama pledged to the United Nations he will observe. The ruling was issued by the International Court of Justice. Even if someone grew up in the U.S., receiving benefits such as a public education and healthcare, the individual still retains his Mexican citizenship and must be provided access to consular officials if hes charged with a crime. That holds true even if the crime involves torture, rape and murder as was the case with Medillin vs. Texas.
Jose Medillin, a young man who grew up in the U.S., claimed Mexican citizenship during proceedings over charges he raped, tortured and killed two teen girls. Medillin had waived his rights and written a lengthy confession. Despite efforts by the administration of President George W. Bush to appease Mexico, Medillin was executed by the state of Texas.
Mexico had filed a lawsuit against the U.S. over 51 Mexican nationals sentenced to Death Row in US states. Mexico claimed the nationals were deprived of their right to consular assistance. This is a key issue in immigration reform but its an issue no politician ever talks about. It is likely most in Washington would be unable to even define what Avena means...
