Judge sentences Tom DeLay to 3 years in prison

judge has ordered U.S. House Majority Leader Tom DeLay to serve three years in prison for his role in a scheme to illegally funnel corporate money to Texas candidates in 2002.

The sentence comes after a jury in November convicted DeLay on charges of money laundering and conspiracy to commit money laundering. DeLay was once one of the most powerful men in U.S. politics, ascending to the No. 2 job in the House of Representatives.

The former Houston-area congressman had faced up to life in prison. His attorneys asked for probation.

I guess that's what happens when you put faith in a bunch of liberals.

The jury of six men and six women consists of a Republican, six Democrats, two independent conservatives and three independent liberals, DeLay said.

He said he was putting his faith of acquittal with the liberals because they were more empathetic. "I know them like they're my brothers and sisters," DeLay said.

Not William Jefferson. He’s I believe serving a 13 year sentence - pronablu a life sentence given his health.

The jurors were given a set of instructions and the charge did Tom Delay do this. The jurors questioned if it was against the law to do that. The judge refused to answer and made them answer did he do “this”. They responded that yes he did “this”.

It will be up to the appelate court to determine if “this” is really against the law. Most lawyers indicate they don’t think it is a violation of the law, but the jurors were not given the opportunity to determine that. They are given a charge by the judge and their task is to carry out that charge.

I do not think Tom Delay did anything remotely illegal. However, based on the charge that the judge gave the jury, it would be hard for them to have decided any other way. The Jurors asked questions that would have given them an out, and the judge refused to answer.

Hmmmm...That is what I thought you said, in addition, you stated:

"The jurors were denied information by the judge and basically had no choice but to vote guilty".

As I said, ya got some bizarre events happening down there in Texas.

You mean beyond having his career ruined, spending millions to defend himself and being publicly slandered?

Yes DeLay has posted a $10,000 and will out while the appeals process is ongoing.

$10,000 bond on a potential life sentence?

That is peanuts and to me illustrates that those in the know recognize this will be thrown out on appeal.

No, Texas is one of the few states where the Governor does not pardon power. That is a legacy from Ma Ferguson getting caught selling paroles.

Delay was accused of violating a Texas state law, not a federal law. One good thing is because of the length of the sentence, Delay is eligible for an appeal bond, so he won't go to prison immediately and the Texas Court of Criminal Appeals will have an opportunity to rule on his conviction before he will have to report to prison. All 9 members of the Texas CCA are Republicans.

B)DeLay was convicted under state, not federal law, and as you may have noticed we and not democrats control all three branches of gov’t there

again, McCain Feingold don’t enter in to it because the conviction was under Texas state law. point your outrage in the proper direction, otherwise we all look a little more ignorant

The judge in this case, Pat Priest, is a retired state district judge from San Antonio, not Austin. He was appointed to the Delay case by the Republican Chief Justice of the Texas Supreme Court. Judge Priest is considered one of leading experts of evidence in the state and was an adjunct law professor for several years at the local law school.
