Basically this (from http://dailyreckoning.com/opt-out-of-social-security/):

• Convince them you are part of a religion that is “conscientiously opposed to accepting benefits of any private or public insurance that makes payments in the event of death, disability, old age or retirement.”

• Have a ranking official of this religion authorize that you are a true believer

• Prove that your religion has been established – and continually opposing insurance – since at least 1950.

So, yes, you can opt out. Just become Amish and all is well.

Another key difference is passive confiscation versus active contract. You pay SS in the roughly same manner as you pay income tax, and if you don’t they send them durn revenuers after you. ObamaCare is different in that it forces you to make a contract against your will, assuming you don’t want to have health insurance or do business with a particular private sector insurer. That’s why the Virginia case went against the Individual Mandate. SS assumes you are passively letting the fed take your money. ObamaCare is forcing you to actively make a private sector contractual relationship you don’t want to be in. What’s next? Forced marriages? There’s another name for that.

OTOH, Article I, Section 8 "lay and collect Taxes, Duties, Imposts, and Excises, to pay the Debts and provide for the common defense and general Welfare of the United States," has all too often changed the 'general Welfare of the United States' into meaning 'the general welfare of the Citizens of the United States'.

That, to me, is a very perverted way of reading it.

But that same federal government, without any ability of the individual to respectfully decline, FORCES the payment of a fixed percentage of every single paycheck and pretends they are putting it in a special stash to dole back out in retirement in what they call ‘social security’ checks, which is just another of many unsustainable welfare schemes. Perhaps he’s confusing his constitutions or, more likely, intentionally bankrupting the children of his constituents. This never ends with these people with socialist beliefs. The previous generational ripoff becomes the next generation’s excuse to further ripoff the ones to follow, because it’s all working out so well, for them. Only those we the people empower can rip off us and our children with no crime having being committed by those who write the laws. Yet this federal government racket is no less corrupt, and so much more lucrative than all mobster enterprises combined. There must be a lawyer somewhere who can stop this criminal enterprise called federal government from continually expanding how deeply they can borrow to further reach into our kid’s pockets to repay. I must have mistakenly believed that it was the US Constitution that protected each individual from that very outcome. If not for me, then for my children, this generational theft must ALL be repealed as it is ALL very much unconstitutional. Mr. Conyers will no doubt soon be voting to raise the federal government debt limit once designed to prevent economically devastating DEBT! It’s about the DEBT Mr. Conyers! Look at the rate of the accumulation of mandated DEBT Sir! This really can’t end well with such jack wagons in positions of ever increasing power.

One small point - SCOTUS long ago ruled that SS, etc. were simply taxes...

Thanks, I feel so much better about it all now since they aren’t making us buy ‘insurance’, but merely taxing us. Perhaps Conyers will amend the HC law and scribble in “this is only a tax, not a mandate”, and all will be well with the world and the era of ‘free’ health care and unicorns for all will begin as all the populous sings praises to their dear leaders ... or not. I do feel a lot better for letting out the rant though :)
