An appellate court has ruled that Rahm Emanuel is not legally a resident of Chicago, and therefore cannot run for mayor. The decision overturns a previous ruling.
“We conclude that the candidate neither meets the the municipal code’s requirement that he have ‘resided’ in Chicago for the year preceding the election in which he seeks to participate nor falls within any exception to the requirement.”

UPDATE: ”The Supreme Court is absolutely loathe to overturn an appellate court decision,” an Illinois lawyer tells Politico’s Ben Smith. I have heard much the same from others familiar with Illinois judiciary — the state supreme court is expected to be even less-friendly to Rahm than was the appellate.

No fan of Rahm, but this is a terrible ruling and smacks of “Chicago Machine” politics. He was a Chicago congressman, he went to work in the White House - even keeping his Chicago house, and then he comes back and isn’t a resident?
This isn;t a carbetbagger story, this is a Chicago guy who’s being prevented from running because he would win.
Maybe we could get these guys to look into that birth certificate thing.

It’s very out of character for Rahm to omit someone from the bribe list. I guess some Federal judgeships will be promised forthwith.
I think the judge will be getting a suitcase full of cash and a pre-written note he will read on TV saying he has found evidence to clear Rahm.
Perhaps he should consult with Lisa Murkowski on what to do next?

I am curious. I suspect that Daley still holds the power to select his successor. Did the Appellate Court do what Daley wanted them to do, or did they actually decide it on points of law?
If Daley meant to undermine Rahm, as some speculated in the early days, wouldn’t he have done it with that first Chicago judge?
I suspect that Daley still tells Obama what to do, rather than the reverse.
Maybe we can get the court to review a certain pResident’s status.
Not true-they are using the same ruling MI is, in keeping me from claiming residency even though I own two houses there. I haven’t lived there for 5 years. 2 years ago a County Treasurer found out i was renting the homes and denied my Homestead Exemption, even though a friend is renting one of the houses and I am back there frequently.

No kidding, he isn’t a resident of Chicago. He hasn’t been for several years.
He will still try for a write-in candidacy and likely win with all the shenanigans that go on with Chicago politics.
This doesn’t matter, he doesn’t even need to be on the ballot. If certain “people” want him to be mayor, he WILL be mayor.

Maybe you didn’t know Rahm was living in DC. And working for Obama. In fact he amended his tax returns when he decided to run for Mayor to state that he was a fulltime resident of the city.
This court actually read the letter of the law and applied it.

Now if we could see the same kind of thing happen with Obowma's BC...
Since these are State courts then it pays to remember that the judges are going to rule in favor of the pols who appointed them.
It wouldn't matter. He's been found ineligible for the Office at all. A write in campaign would be a futile move. They wouldn't even count the votes.

I tend to agree with you. It’s not like the guy just showed up from Arkansas or something and never had anything to do with Chicago before.

This and the Bears got their butts handed to them. The karma is knee deep around the hog pen called Chicago. Now let more of the Windy City’s seedy underside get exposed. The rest of the State of Illinois doesn’t deserve to be dragged along with the filth of Chicago.
Our nation didn't let that happen in the past - they were allowed to go to DC for only three months out of the year. We should demand a return to that sanity.

Emanuel’s argument is a variant of Bill Clinton’s famous line.

Rahm intended to live in Chicago, therefore he’s a Chicago resident.
Maybe he can find the judges in the gym and try to intimidate them in the nude while executing ballet routines.
