The Illinois Supreme Court has agreed to hear the appeal of a court decision that knocked Rahm Emanuel out of the mayoral race.
Earlier, the Supreme Court ordered the Chicago Board of Election Commissioners to put Emanuels name back on the mayoral ballot while it considered Emanuels appeal of Mondays Illinois Appellate Court ruling that tossed him out of the race to replace Mayor Daley.
The Supreme Court said it will not accept any new legal briefs or even hear oral arguments on the case. Instead, the court will rely on the briefs already filed at the appellate court level.

I wonder why they just did not stop the printing.
I think that Chicago can decide whether to print immediately or wait a bit. I don’t this is the SCs job.

Because they’ve already made up their minds in favor of Emanuel?
Early voting is scheduled to start next Monday, the 31st, and the printing of the ballots was started earlier today. If they don’t include him on the ballot right now, they won’t have enough time to add him later, assuming the Supreme Court goes his way.
If he’s on the ballot and ruled ineligible, then people are stupid to vote for him.
Is SCOIL — corrupt? We’ll find out.
Me neither. Today the state elections guy was saying on WLS that if the SC put him back on, they’d just destroy the ballots and reprint them. Same thing if they go ahead with his name on and then later decide he’s ineligible.
That was my thought, too. Why does this concern the Federal Government. It's clearly a state issue and state laws apply.

The federal government has nothing to do with it. This is the Illinois State Supreme Court’s ruling.
And as I said, I don’t believe they have any time to wait. Early voting starts Monday.
The first drama will be to see if Judge Anne Burke recuses herself. Her husband is the most politically powerful Chicago Alderman and the biggest supporter of Gery Chico, who is also running for Mayor.
She may try to claim she’s independent of her husband, but she would never be sitting on the IL Supreme Court if that were true.

This has not yet reached the USSC. However, the 14th Amendment applies ~ check the spot where it says "No state shall......" so anything following that can go to the USSC without a lot of complaint.
BTW, the members of the court who just knocked Rahm off the Chicago ballot were split 2 to 1. The 2 voting against Rahm are Chico supporters.
Now, to the Illinois SC where the array is different ~ not less corrupt of course.
Rule of law means nothing in Illinois. That's why they are overrun with criminals, the state is bankrupt, they're pumping raw poop into Lake Michigan half the time AND, worse, they've got SnakeHead Fish munching their way up the Chicago River!
Justice aint cheap and the more you pay the more you get.

At least Springfield isn’t Chicago, so the machine’s thugs can’t issue direct orders to the bureaucracies and courts.
I really don’t know which way to go on this one. There is irreversible harm in stopping the printing, so I don’t draw a conclusion from that. Interesting that they aren’t taking any more arguments, all the facts stand and it’s only a question of precedents and definitions. I read the opinion and the dissent of the appeals court. Both had some merit, but I think the majority wove an overall tighter and more consistent case. The dissent made me laugh on the supposed point of needing to be deferential to the earlier decisions. The court had decided to review de novo, where deference goes out the window.
I suspect there’ll be some fattening bank accounts in the immediate future of at least four of the seven justices.
