At least two lawsuits were filed on behalf of environmental groups who contended the Martinez administration was illegally stopping pollution control measures from taking effect. The rules at issue were adopted in November and December by Richardson's environmental appointees to the state's environmental regulatory board.

The good news is that Susana appointed four new members to the five-person board so there is a good chance they will order at least a review and hopefully a repeal of the rules. On the other hand, the legislature may step in and legislate a rule that says the agency can not adopt rules for greenhouse gases absent proof that such gases are responsible for climate change.

Gov. Martinez names new environmental board

Gov. Susana Martinez on Wednesday nominated an Intel executive, a Capulin rancher and two attorneys to the state Environmental Improvement Board.

In announcing her appointees, Martinez said the board is "responsible for implementing common-sense environmental regulations without stifling economic growth and development in New Mexico."

She also said, "Protecting the environment and jump-starting our economy are not mutually exclusive goals. It is critical to New Mexico's future that bodies like the EIB make thoughtful decisions based on science and common sense rather than political whims that circumvent the will of the people."

Rogle, I threw this comment in to my post but it may be wishful thinking as I haven't heard whether the legislature is going to take any action. Have you heard any rumblings?
