Virginia AG: State would have to self-fund militia if it wants to ban gays from national guard

RICHMOND, Va. (AP) — Virginia would have to establish and fully fund its own independent militia if it wanted to ban gays from its National Guard force, Attorney General Kenneth Cuccinelli says.

Cuccinelli issued an advisory opinion earlier this week at the request of Del. Bill Janis, R-Henrico, who asked whether the legislature can order the Virginia National Guard to continue the"don't ask, don't tell" policy recently repealed by Congress.

I would argue that it’s not a state militia if the fed is paying for it...

And does that also mean that the fed cant call them for overseas deployment?

“don’t ask, don’t tell” will now apply to conservatives and Christians who will be punished for uttering anything that could possibly be construed as anti-gay

If the feds think that fed funded state militias are the only militias around they’re more stupid than even I given credit for. And I give them unlimited credit!

Absolutely; I would imagine the Founders never intended for a National Guard to be the militia.

The government probably has undercover agents inside every militia in the United States, whether FBI or from state/local police.

Takes some time to organize manpower and transportation and supply lines. The Fed could stop it before it happens.

And the downside is?

Virginia has a lawsuit against DeathCare; in effect, to nullify the bill. Why not extend that to ALL federal mandates, starting with unfunded mandates?

Will Virginia lead the way once more?
