Judge may escalate battle over healthcare reform

MIAMI (Reuters) – A Florida judge could on Monday become the second judge to declare President Barack Obama's healthcare reform law unconstitutional, in the biggest legal challenge yet to federal authority to enact the law.

The judge, Roger Vinson of the U.S. District Court in Pensacola, Florida, was expected to rule on a lawsuit brought by governors and attorneys general from 26 U.S. states, almost all of whom are Republicans. Obama is a Democrat.

The plaintiffs represent more than half the U.S. states, so the Pensacola case has more prominence than some two dozen lawsuits filed in federal courts over the healthcare law.

No specific time has been given for Vinson's ruling, which was unlikely to end the legal wrangling over the contentious reform law, which could well reach the U.S. Supreme Court.

And yet, Michigan and Washington are part of the suit too, and they're Democrat-run

so the opposition to ObamaKare is "bipartisan" ....

Notice how the suck-ass media frames this in a POLTIICAL way, and not in a CONSTITUTIONAL setting?

The frickin’ thing is an affront to at LEAST the 10th amendment, which ALONE should make it unconstitutional...too bad the so-called “journalists” in the USA wouldn’t know the Constitution if you took a copy of one and crammed down their throats.

The judge has to decide whether to follow the US Constitution or be on the short list to be Obama’s next SCOTUS nominee—same deal the Illinois Supremes got over Rahm Deadfish’s Chicago residency requirements.

Tough choice.

The Judge’s decision is, whatever it maybe is Unconstitutional per Article III Section II of the Constitution! SCOTUS is to be the court of original jurisdiction whenever a case involves a state!

Washington State has a Dim governor (Christine Gregoire), but the SoS is a Republican - McKenna. McKenna filed the suit and Gregoire fought him tooth and nail on it; and, according to the article below, Granholm (MI) joined Gregoire in the challenge.

The decision of Washington State Attorney General Rob McKenna to join the lawsuit infuriated Gregoire and other Democratic leaders, who argued Republican McKenna’s position doesn’t represent the state’s interests.

Democratic governors Bill Ritter of Colorado, Jennifer Granholm of Michigan and Ed Rendell of Pennsylvania found themselves in similar arguments with Republican attorneys-general in their states.

On Wednesday, they teamed up with Gregoire to seek permission to file a friend-of-the-court, or amicus, brief in a Florida federal court. They want to file the brief in support of the Obama administration’s motion to dismiss the lawsuit.

Michigan now has a Republican governor in Mike Snyder as well as a Republican AG & SOS. I believe the Legislature in Michigan is also both sides Republican.

the judge is a democrat.

therefor he’ll rule in favor of obamacare.

that’s pretty much the way the florida democratic judges ruled in 2000 during the bush campaign there. all the democratic judges ruled in favor of the dems during that campaign. this one being political will go the same way.

Reuters: “Obama is a Democrat.”

Reuters has a weird, schizoid sylebook, which I never understood. Anyone who needs to be told that Obama is a Democrat is not spending his time reading news articles.

I remember years after 9/11, a standard line in Reuters articles - stated identically each time - was something like: “The United States accuses Al Queda of perpetrating the 9/11 attacks on the World Trade Center and the Pentagon.”

Something screwed up about Reuters.

The judge isn’t a Dem, unless President Reagan went through a let’s-nominate-Democrats-to-the federal-bench phase I never knew about.

It should be noted that the

Communist Party of the USA (CPUSA)

decided a few cycles ago that it was unnecessary and counterproductive to run their own candidates because the DemocRat party represents their views so well.

Please, everyone, go to my about page for info on a MUST SEE documentary. No, I’m getting nothing out of it! :)

Different court. You are right about SCOFLA, a corrupt institution. Their Bush v Gore ruling opened my eyes. "Rule of law" is "Rule of force." Intellectual honesty may or may not be present in any given court.

Understood. Just pointing out WA state, and at the time (e.g., before the last election), Granholm (MI-Rat) were against their states filing the suit.
