Judge Halts Implemenation of California Cap and Tax

Thanks to Ronald Reagan’s legacy and a legal miscalculation by leftist environmentalists, this week a California judge stopped the implementation of California’s Cap and Trade law: better known as Cap and Tax. This is the same type of carbon trading that Al Gore has hawked for years, but failed to get through the most radical Democrat Congress in generations. That’s how bad it was. Of course, that didn’t stop whacked out California from passing a Draconian version of the same job killing scheme.

California nutcases aka the legislature had passed Cap and Trade, despite its failure of passage in Congress. Now a judge put the brakes on that. Thank you, Lord.

Actually the greenies, supported by the National Rifle Association, used closure of a gun range by a community college (the NRA was punishing the college for closing the range) in my area to create a legal precedent that "ceasing to pollute the environment" (because no more gun lead was getting into the environment) was itself an impact on the environment requiring an environmental impact report.

The law out here is so twisted that the California 5th District Court of Appeals said this had to be done even though the gun range had been closed long before the NRA squawked about its environmental impact.

The greenies also bring environmental suits to block construction of solar power plants on vacant land which gets lots of sunlight, such as in the desert.

They basically don't want anything going on anywhere. And California voters support them. This occasionally leads to green on green fights like this.

I've told my children to get the **** out of California, and there is an increasing chance that my wife and I will move out when we retire in another 5-6 years.

Uh, point of clarification: Pelosi did get it through Congress. It brickwalled in the Senate.

The senate is the other half of congress. The House of Reps being the other part.

Ah. OK. The usage of the term “Congress” can have different meanings. Confusion could have been avoided had the term “Legislature” been used (but I think the author did that deliberately so some semanticist can come along and justify the exaggeration).

“Congress” was once synonymous with “Legislature,” but seemed to have evolved over the centuries to be the same as “House of Representatives.” Common usage now of the terms “Congress” and “Senate” are as separate concepts.

CARB will produce a study with whatever conclusion supports their preconceived goals. The conclusion of this study will be that there are no alternatives to Cap and Tax. They will have fulfilled their obligation and the judiciary will have to allow it.

This won’t be any different than cramming the poisonous pollutant MTBE through as “safe and harmless”.

This is just a delay. The job-killing law will be delayed, replaced by job-killing uncertainty for businesses.
