Dems: Thomas should recuse himself
By JENNIFER HABERKORN | 2/9/11 11:27 AM EST

Seventy-four House Democrats are asking Supreme Court Justice Clarence Thomas to recuse himself from any health care reform cases, citing reports that his wife financially benefited from efforts to repeal the legislation.

The members, led by Rep. Anthony Weiner (D-N.Y.), ask that he “maintain the integrity of this court.”

**SNIP**

The move comes after Republicans have floated similar concerns about the impartiality of Justice Elena Kagan, who was solicitor general during the health debate.

He won’t go anywhere. They can’t do anything. I hope and pray Justice Thomas will sit on the bench for 100 more years.

These radical racist Liberals they are forever attacking the only Black Supreme Court Justice and this has nothing to do with politics it is simply because of the color of his skin. You would think in America these liberals would have gotten past this. Yes Libs we can have a black Supreme Court Justice that is free to rule on the merits of cases in his own volition.

Note: I just knew they were going to try and go this route they are very afraid and I have no doubt that it is Obama himself putting them up to this.... soon the PRAVDA media will start a State run attack on certain members of the Supreme Court.

The Libs forget this is America and their Stalinist tactics won’t work here..... Not yet anyway...(as proven on Nov 2nd 2010.)

Let me get this straight. Kagen is directly involved in creating the travesty called Onadacare. Thomas’ wife works for a lobbying firm that will allegedly benefit from the demise of the unconstitutional Onadacare. So somehow, the second situation is analagous to the first?

How would Thomas’wife’s firm benefit from the demise of Onadacare? How will Thomas’ wife benefit from same? Does anyone know?

The firm gets paid. That’s all.

If Mrs. Thomas worked for Macdonald’s and a case came up that involved MacDonald’s, the scenario would be the same.

____________

She has set up a lobbying business and PAC that is trying to repeal the health care law. If this was a liberal judge and his wife was being paid as a lobbyist to have legislation overturned, I’m certain that we would not have a problem with it.

Thomas should step away with the caveat that Kagan do the same. Scalia, Roberts and Alito can han dle this.

But we know that Kagen will not step away. Therefore, there is no reason Thomas should. Changes nothing as far as the balance of power on the USSC. Conservatives still rule.

It's my understanding that Justice Kagan had a direct association with the Affordable Health Care Act in her former position, and, thus, should recuse herself. Justice Thomas did not. There is absolutely no reason for him to avoid participating in this case. His wife's work and/or opinions have nothing to do with Mr. Thomas’ work and opinions. This is America —2011. Husbands and wives have the right to think independently. They are not one person. Isn't that what Feminism was supposed to be about?

If Thomas recuses himself from this case, it will set a dangerous precedent. In any given case, one could argue that any given justice should recuse himself for any given reason. It’s only a matter of how cleverly the pile of bull$#!+ is arranged.
