The Law Is For Presidents Too

Checks And Balances: A federal judge has told the government it can't implement ObamaCare because it's unconstitutional. Has the White House complied? No, it's knowingly breaking the law.

Less than three weeks ago, U.S. District Court Judge Roger Vinson ruled from his Florida courtroom that the Patient Protection and Affordable Care Act violated the Constitution.

No, he didn't order an injunction to shut down enforcement of the law as the plaintiffs had asked. But he did cite a previous case and note that his ruling "is the functional equivalent of an injunction."

As if he anticipated the administration ignoring his opinion, Vinson also wrote he expects the "executive branch" to "adhere to the law as declared by the court."

Given this, can there be any question he was saying the law cannot proceed as a function of government? In clear and certain terms even a non-lawyer could understand, the administration was told to cease and desist.

Of course, the White House disputed the ruling and within hours vowed it would "proceed apace" with implementation. Officials decided that their disagreement, as well as their confidence that the ruling will be overturned, were reasons enough to dismiss the order.

The defiance was on display again last week. Testifying before the House Ways and Means Committee, Donald Berwick, administrator of the Centers for Medicare and Medicaid Services, told Rep. Lynn Jenkins, R-Kan., that "I will continue to implement it."

Yes, and Vinson also said he was “voiding” the law. How much clearer could that be?

The laws do not apply to these people and ALL the media and ALL TV back them. Republicans and the citizenry have “no standing.”

I heard a couple in their 60s the other day talking at lunch. She was saying “we worked all our lives, paid taxes and saved and now they are pulling the rug from under us.”

With the Senate in Harry Reid's and the rest of the Democrats hands, that won't go anywhere. We need to cripple Obama's ability to implement Obamacare along with C02 regulations, etc. by denying funds through the appropriation process IMO.

The plaintifs, IE: the states MUST go back to court and request that the judge make the administration comply,or hold them in contempt and jail Eric Holder for contempt until the administration complies with the ruling of the court, Or they receive relief from a higher court.

Come Now Obama is the president of the USA. he believes he is the supreme law of the land. A judge has informed that Obamacare in null and void, he continues to implement it. Another judge has stated that oil drilling moratarium is unconstitutional and Obama tells his secretary of the interior to dictate a new policy stating the maoratarium is in effect for 7 years.

The Supreme Court ruled another bill McCain-Feingold Finance reform and the issue of corporate Donations as unconstitutional - he castigates the Supremes in the State of Union in 2009 and strives to rewrite the law.

Barack Obama is overstepping his authority as a president and he needs to be knocked down to understand the president of the United States can be limited by the provisions that the Founders deemed Checks and Balances - Executive Branch can be limited by the Legislative Branch and the Judical Branch can rule when other branches overstep the constitutional authority.

Why does not the legislative branch gain the fortitude and the backbone to say enough to the Executive Branch?

He controls, Hollywood, ALL of TV and ALL of the media. He also controls the money printing presses and the military and intelligence agencies.

Now Bill O’Reilly goes into Olberman mode attacking birthers along with Anderson Cooper.

The law is whatever he say it is. We have “no standing.”

A sane and moral people, with a clear understanding of the simple language of the Constitution, would rise up en masse and demand his ouster NOW.

Obama isn't just a bad president. He's an enemy of The People and our fundamental liberties.
