Why the Supreme Court has been compelled to hold a new hearing on Obama’s eligibility.

Drudge has linked this story from World Net Daily that notes the odd decision by the Supreme Court to hold a new “conference” on Obama’s eligibility to hold the presidency.

Let’s research WHY the court could be compelled to do this.

It MUST have something to do with the fact that Obama has no birth certificate on file in the Hawaiian Hall of Records with the name “Barack Hussein Obama” on it — since his original Hawaiian birth certificate with that name was sealed in the 1970s when he was adopted in Indonesia by Lolo Soetoro, his stepfather. At the time of adoption, a child’s original birth certificate is sealed away and replaced in the Hall of Records by a new birth certificate that bears the adopted parents’ names and the child’s new name, if a new name is given.

This is what happened to Obama, when he was renamed “Soetobakh” by his mother and stepfather at the time of adoption.

Sven Magnussen has posted copies of US State Dept. documents explaining how a US citizen minor can indeed renounce US citizenship. It can be done.

If Sven doesn’t reply, his comments can be searched as he has posted this info quite a number of times.

“if you read the State Department’s own manual on citizenship they specifically separate the definition of Natural Born citizen from Naturalized and Birthright Citizenship.”

I wrote about this a long time ago. I went through my postings and I have been yapping way too much. It would seem to take a long time to get back to those discussions, but I looked this up and was shocked to find this discussion.

I will see if there is any way to dig this up again.

Considering the fact that many dispute his sire and perhaps even his mother, then this State Department ruling would certainly have some bearing on the issue...

7 FAM 1118 FOUNDLINGS
(CT:CON-314; 08-21-2009)
a. Under INA 301(f) (8 U.S.C. 1401(f)) (formerly Section 301(a)(6)) INA), a child of unknown parents is conclusively presumed to be a U.S. citizen if found in the United States when under 5 years of age...

Indeed, there are many who would argue that he was "found," not "born" given the complete absence of a historical record.

The reason I ask is that I remember a conversation on a blog back in the summer of 2008 when on of the participants had worked for the State Department.

The conversation concerned Natural Born Citizenship and its Constitutional origin. She related how even the State Department couldn’t get the definition correct in their manual!

So if you have that information it would sure be insightful. I suspect there has been a great deal of confusion over this issue for a long time.

I just reviewed the U.S. Department of State Foreign Affairs Manual Volume 7 - Consular Affairs, Section 7 FAM 1100 ACQUISITION AND RETENTION OF U.S. CITIZENSHIP AND NATIONALITY and Section 7 FAM 1110 ACQUISITION OF U.S. CITIZENSHIP BY BIRTH IN THE UNITED STATES and can find no definition of NBC.

Stanely Ann Dunham Obama Soetoro, the mother of Obama, her passport records for 1960-1965 have been withheld from FOIA requests. The government claims all passport records from those dates have been destroyed, but that has been proven false by researchers.

These records, plus Obama’s Hawaiian public school record for kindergarten, have purposely disappeared.

He wasn’t born in Hawaii, and no, I don’t think he just popped up somewhere as a foundling.

I don’t think the reconsideration has to do primarily with eligibility, rather with atty Hemenway’s snookering the court or gettting one past them by making a motion for recusal of the two obama appointees. The court did not act on the motion so it should be granted. Accordingly they should be recused from this conference.

Whether they accept the case or not is still up for grabs. Two things of note, Abercrombie’s supposed statement there is no long form for Obama as well as the latest poll showing millions of Americans doubt Obamas place of birth. Despite trying to avoid the issue the SCOTUS will have to hear it sooner or later. The last consideration was about 30 days ago and the only significant news since then was Aercrombies and the new poll.

and can find no definition of NBC.

That is because Natural Born Citizenship (as defined by Vattel, and understood by the founders) is not the result of any statutes, or legislation, or legal action of any kind.

A Natural Born Citizen is one born in the country to two citizen parents; there is no question of citizenship, or of any natural allegiance to any other country, and therefore no need for any legal action or legislation to define their status.

Of all the presidents of the USA, all except two have been born in the USA to two parents who were citizens at the time of the president's birth. The two exceptions were Chester A. Arthur and Obama.

Has he investigated whether or not the president got into with “foreign student” loans? If he did, it was either fraud, or he was ineligable to be President!

<>There are a couple names that could appear on the birth certificate Hawaii has on file for the current US President because of the odd circumstances involved in Indonesian names. Here are a few options:

* Soetobakh Dunham

* Soetobakh Soetoro

* Barry Soetoro

How about "Socialista Suckeyboy" * Soetoro Soetobakh

SatinDoll said:

I know that there are three types of statutory citizenship: native born (born in the U.S. to legal residents); citizenship-by-statute (born overseas to one or two U.S. citizen parents); and naturalization (foreign-born but naturalized as citizen).

There is much confusion with regards to citizenship classifications. The 14th Amendment did a wonderful job at obfuscating common citizenship laws.

Only two (2) different classifications of citizens exist within the U.S. Constitution:
  1. Natural Born Citizen
  2. Citizen of the United States
The 14th Amendment is very clear on who constitutes a Citizen of the United States. These are the types of Citizens of the United States: This bears repeating...

The 14th Amendment in no way clarified or redefined the Natural Born Citizen clause in Article II. It couldn't. The 14th Amendment was written to ensure emancipated slaves would be considered citizens of the United States upon its ratification in 1866. Slaves were considered property, not citizens. They could never be natural-born because there is no such thing as a retroactive natural-born citizen.

Since we know the 14th Amendment in no way changed the definition of "Natural Born Citizen", we must turn our attention to other definitions commonly accepted in 1787. The mere mention of this phrase is somewhat difficult to pinpoint, even at the time of the Convention. However, de Vattel, Cicero, Smith and several citations of correspondence between the framers reveal its correct definition.

A natural born citizen is one who is, at birth:
  1. Born on U.S. property
  2. Born to a citizen father
  3. Born with sole allegiance to the U.S.
We deduce this definition by:

Everything seems to be consistent with the proposed explanation that Obama's original Hawaii Birth Certificate was a result of a affidavit filed by his grandparents.

That's been my explanation for about the past year.
