Immigrant rights advocates claim federal agents violated rights

JACKSON, MS (WLBT) - Immigration rights advocates claim federal ICE agents violated the human rights of immigrants during a recent raid in central Mississippi.

Dozens of broken families flooded the Mississippi Immigrants Rights Alliance headquarters Wednesday after the four day federal immigration raid. Many claimed their loved ones were cursed and physically abused before being arrested and possibly deported.

"They had their guns out and they was running around the apartments with guns out and one guy that jumped from the window trying to get away from them they had their gun to his head on the ground with knees in his back," said Glenda Arevalo.

17 to 71, were wanted for violent and sex related crimes and selling drugs. They say 11 of the fugitives ignored final orders of deportation from the courts.

When you are arresting people like the above it will never be pretty. The illegals are attaching human rights to everything. If I am arresting violent, sex related crimes and drug offenders, you better believe I will have my guns out and ready to use. After watching D.E.A. on tv these drug dealers are well armed and have attack dogs.They will pop a cap in you in a heartbeat. They are playing up to being victims, rather than the hardcore dangerous criminals they are.

They weren't just illegals they were criminals as well. Kick them the he!! out of our country. The USA is for citizens or legal visitors only. Not one dime should be spent on illegals except to kick their butts out. Our military should be stationed on our southern border and that fence should be electric with a good jolt.
My attitude about illegals has changed form one of tolerance to one of exclusion. We need to take care of our own and get rid of the rest.

“Manhunt!” With that bold headline, the Sunday Advance reported Staten Island District Attorney Daniel Donovan’s determination to capture this county’s Top 10 fugitives.

The Advance is assisting Donovan’s initiative by displaying these individuals’ faces on the newspaper’s CRIME SCENE Web page, silive.com/crime.

Two especially galling aspects underlie this story. First is the indefensible decision by a Criminal Court judge that allowed Linares Hugo Lopez, an illegal immigrant from Mexico who is number one on the list, to walk away from accusations that he horribly abused his 18-month-old son.

Second is the ease with which far too many illegal immigrants avoid answering for even the most violent crimes committed by them.

When examined by medical personnel, 18-month-old Lester Martinez exhibited third-degree burns over 40 percent of his body, and what appeared to be choke marks on his neck and cigarette burns on his shoulder.

After doctors found the explanation given by his father to be inconsistent with these catastrophic injuries, they notified police.

According to officers from the 120th Precinct, after his arrest on May 31, 2005, Lopez tried to deceive them as to his identity.

When his true name was finally ascertained, Lopez was arraigned in Criminal Court in Stapleton on June 2 on charges that included first-degree assault, a Class B felony.

Veteran Criminal Court Judge Alan Meyer fixed bail in the amount of $500,000. Thus detained, Lopez indicated that he wanted to testify before the grand jury.

Since the grand jury was already hearing evidence in the case, the district attorney’s office immediately transported him to St. George so that he could testify as requested.

Bear in mind that Lopez, an employee for six years at a Mariners Harbor supermarket, had spoken English during extensive interviews with police. Furthermore, he signed a comprehensive statement written in English

Nevertheless, when he and his attorney arrived in St. George, they demanded a Spanish interpreter. It appears to have been a move calculated to delay the proceeding, a position that Donovan understandably maintains to this day.

Since it was now after 5 p.m., the interpreter had already left, and diligent efforts by Donovan’s office to obtain another one were unsuccessful. Moreover, the grand jury was not scheduled to reconvene until June 7.

CONTROVERSIAL RULING

When the case appeared in the Criminal Court on June 6, Lopez, arguing that he had not been indicted within 144 hours of his arrest as required by law, demanded to be released on his own recognizance.

However, the applicable statute contains an exception for circumstances where the district attorney demonstrates “good cause why such order of release should not be issued.”

I’ve reviewed the official stenographic transcript of that June 6 proceeding. The presiding judge was now Ferne Goldstein, a lightweight Civil Court judge who had been assigned to the Criminal Court.

Citing Lopez’s demonstrated facility with the English language and the confusion precipitated by his unforeseeable demand for an interpreter, Assistant District Attorney Santosh Madahar clearly presented good cause for denying his bid for immediate release.

Goldstein initially agreed, even stating that Madahar need not argue any further.

Then, however, in an inexplicable about-face, Goldstein declared, “in any event, he does have to be released.”

Thus, to the consternation of outraged prosecutors, Lopez, the illegal immigrant facing a potential 25-year jail term, walked out of the courtroom on his own recognizance. Although insisting that he would appear before the grand jury the following day, he hasn’t been seen since.

Donovan now faces the daunting task of having to deal with the consequences of Goldstein’s outrageous refusal to detain Lopez for just one more day. This, while spineless politicians watch and illegal immigrants and their organized advocates become more brazen by the day.

There’s much of the problem. You don’t run from law enforcement! These folks just don’t get it...the RULE of law...and NEVER will!
