Paraplegic faces jail in violent citizen’s arrest

Cape and Islands District Attorney Michael O’Keefe is pressing ahead with a felony assault charge that could put a paraplegic grandfather in the slammer for up to 10 years for whacking his 3-year-old granddaughter’s alleged molester with a Louisville slugger after setting a trap for his arrest.

As a result of 57-year-old Martha’s Vineyard computer salesman Frank Hebert’s unconventional citizen’s arrest, Joshua A. Hardy, 27, of Middleboro, now faces child molestation charges in a second case out of Wareham involving another little girl, authorities tell the Herald.

Sounds like the perp was the child's stepfather. There is nothing better for children than living with their natural parents.

If I'm very, very good maybe God will let me sit on the grandfather's jury. I don't believe there is a remote chance of a conviction, regardless.

Statistically the step father is 10 times more likely to abuse or molest a child than the natural father. Of coarse women and family courts don’t really care too much about that as evidenced by current trends.

From the article: Hebert said he pointed the bat at Hardy and ordered him to stay seated until police arrived, but Hardy, he said, stood up and laughed at him — and that’s when he used the bat.

So what's the problem here? Since the grandfather was in a wheelchair, he could not pin the perp to the ground or even hold him.

The grandfather used the minimum amount of force available to him to detain the perp.

Statistically something like one in three or one in four people in Massachusetts are normal. There’s only like about a 3% chance of not even one normal person on the jury.

So what's the problem here?

For me the problem is that the grandfather did not make a good faith effort to split open the prep's nogin. Other than that, no problem.

No problem at all. In fact, I think the perp laughed and then threatened to kill the wheelchair-bound grandfather who swung when the perp lunged toward him.

Excellent observation! If the grandfather would just think about it for a second, I'm sure he'd remember that the perp muttered a death threat under his breath.

This is an obvious case of self-defense.

I think the scattering of old 'Guesie fishermen and bakers and shopkeepers will produce at least one normal person. Besides, even most [colorful description of a homosexual men] don't like male pederasts who prey on three year old girls. Or boys.

The only reason he didn’t mention the death threat before was he was trying to go easy on him. Same reason he didn’t split his skull.

What happened to Amiraults could have happened almost anywhere in the U.S. at that time. It was a disgrace and more or less put an end to Scott Luther Harshbarger’s career.

The disgrace was deepened by the failure of four consecutive Republican governors to offer them a full, complete and unconditional pardon.
