Sorry, but I have issued passports on the basis of US laws.

I hate to introduce reality into all of this, but if you can prove that you were born in this country or its territories, you are considered, with a few exceptions, a citizen and can get a passport on that basis. A US passport identifies someone as a citizen. Millions of people have been granted citizenship on that basis.

There is a reason why ending birthright citizenship has been the subject of bills in Congress. If eventually, one of them passes, then it will end birthright citizenship at least temporarily until it is challenged and then ruled upon by SCOTUS. We may eventually need a constitutional amendment to end it permanently. Until then, we have 300,000 to 400,000 anchor babies born every year to illegal aliens. They are entitled to food stamps, Medicaid, etc., i.e., just like every other American citizen.

“Better to be silent and thought a fool, than to speak and eliminate all doubt.” Perhaps Mitt should have to not only produce a birth certificate himself, but also to provide real proof that he has read and understood the Constitution. Sadly, I don’t expect better from a man who still thinks “Romney Care” is a good idea.

Now things are starting to make more sense. Mitten’s born of a foreign dad and does not qualify under the constitution himself. So the GOP wants Mittens to be the next president...so this is why they are fighting against any court decision on Obama laying out what the constitutional qualifications for the president is.

Annie went for Mittens in the last election. So Annie is against the constitution’s provision of Presidential qualification and does not want it laid out by the Supreme court via a challenge to Obammy.

There you go.

Maybe more GOP rising stars don’t qualify for president under the constitution. Jindal, Rubio(?), Mittens...who else?

The GOP wants to move away from Euro-whites as candidates and as voters. So this is what the are doing with the citizens of the world/open border Dems in bi-partisan agreement.

muawiyah is perfectly capable of handling this, but let me jump in.

The single statutory support for your view, the USC section you cite includes an important qualifier:

(a) a person born in the United States, and subject to the jurisdiction thereof; (emp. added)

The second clause is not throw-away language.

You may know there two types of "subject to the jurisdiction thereof". One is that everyone must stop at stop signs and give way to red lights and sirens. The other, as was said by the authors at the time of the 14th A., is that the individual in question is subject exclusively to the jurisdiction of the U.S. and no other nation.

The latter cannot be said of an infant newly born to aliens.

It is not surprising that the State Dept would overlook that clause and "adjust" its policies in this regard as they apply to passports for anchor babies; State is believed by many to have housed a large population of anti-American from the 1930's, through today.

It is not the State Department that is making that judgment. It is the law of the land as incorporated into US Code. Birthright citizenship is a reality. People who are born here are entitled to all of the benefits of citizenship.

We can argue over what various phrases were intended to mean under the 14th amendment or SCOTUS decisions, but the fact remains that we recognize birthright citizenship. This applies to all federal benefits, including the right to vote. Stop castigating the State Department for enforcing our laws.

I think we can go so far as to DISQUALIFY any individual born in the US but with foreign parents who do not both have an immigration visa ~ on the basis that issuance of visas are regulated among and between nations according to TREATIES ~ which necessitate the OTHER COUNTRY to have some part in the jurisdiction of the parties affected.

Even if the people are here illegally (that is, without a visa allowing them to be here), the treaties of comity and commerce certainly play a part anyway. Private individuals simply can't elect to toss off international laws and treaties and do their own thing.

Mitt Romney is definitely a target person in all of this and he and his "family lawyers" know it.

Look, all of those "citizenship" decisions were made only by State Department ~ with no support whatsoever from statutes or USSC decisions for their interpretation.

That means they are merely administrative decisions and can all be reversed with a single additional decision that takes a different course with a different nuance.

That's all you have to base the citizenship of about 30 million people on. BTW, the no ex post facto constitutional requirement has no impact whatsoever on mere ministerial functions ~ the State Department citizenship decisions in these cases are as permanent as a complaint about overpayment of postage, and may well be of less legal notice than those overpayments ~ lord forbid we are talking about a postage deficiency!

I'd think you'd want legislation to amplify and instruct the Constitutional clause.

Can you be more specific? We have immigration judges who make such decisions along with USCIS that determine who gets to change status. There is a huge immigration industry populated by thousands of lawyers who specialize in immigration issues. Once an illegal alien gets into this country it is very difficult to deport them. One of my friends who used to work in DOJ as a lawyer dealing with immigration issues said the saying around the office was, "It is not over until the immigrant wins." She quit because the system was so corrupt. 60% of all people who receive green cards annually are changes in status from people already here.

You don't have a clue as to what the State Department's role is in this process. Once the illegal gets into this country or overstays his/her visa, it is all up to USCIS. Overseas, the State Department just enforces US law. It is not rocket science nor is there much latitude in making any decisions. Domestically, USCIS is in charge.

We need legislation to change the current laws. I am against birthright citizenship, but it is the law of the land. These are not "administrative" decisions.

We are not really discussing illegals ~ rather, the target consists of people born here whose status as a citizen rests on nothing more than an administrative determination by any number of people ~ not just immigration judges.

Unless someone CHALLENGES these decisions they just sit there building up a huge pool of people like the Romneys who could very well not be citizens.

BTW, most people in this status never apply for a passport or have any other reason to demonstrate that they are citizens.

I think we should get tough on the whole crowd. They have perfectly fine countries. Time for them to go back home!

The State Department doesn't get involved with determing the citizen status of people born here. They issue passports to people who have the proper documents as prescribed by law.

BTW, most people in this status never apply for a passport or have any other reason to demonstrate that they are citizens

Unless we change the laws, birthright citizenship still obtains. As for the illegals, we should be enforcing our existing laws and deporting them. When you have sanctuary states like MD, you just encourage more illegality. I hope the illegals bankrupt the state and commit unspeakable violence against the residents. Maybe then, they will stop electing Dems and passing laws that attract illegal aliens.
