AFAICS, "hate crime" legislation is unconstitutional per the Fourteenth Amendment, which is supposed to guarantee equal protection of the laws. Hate crime laws increase the penalties according to the plaintiff's thoughts and/or beliefs, thus making the protections unequal, and introducing "crimethink" into the real world off the pages of Orwell's book.

Claremont McKenna College psychology professor Kerri Dunn, who had told police that her car was vandalized as she spoke at a March 9 forum on racism, was identified by two eyewitnesses as the person who damaged the auto, authorities said Wednesday.

Professor Kerri Dunn vandalized her own car and then led "Stop The Hate" rallies on campus.

I heard all of Chancellor Holden Thorp’s statement on TV last night. He expressed no criticism of the illegal act committed by the gay student. He just gave us another lecture on the seriousness of hate crimes.
