The issue here was a Federal judge re-writing citizenship laws to create a constitutional citizenship entitlement. This SCOTUS has thrown out lots of crap that got created with Justice O Conner's assistance and that would be another one.

And its 'stuff' like the above why Cass Sunstein is trying by regulation what Barry's commie toadies in Congress can't accomplish by legislation - the Disarming of US Citizens. As they know that in the near future the 'feces will strike the ventilator' and they don't want any resistance.

Ergo, Sunstein now wants the ATF to redefine what a Shotgun is with new regulations (Glenn Beck doesn't call him the most dangerous person in the US for nothing). What he wants is if the Shotgun is not suitable for 'Sporting Purposes' (which HE gets to define), it will be classified and banned as a Military Assault Weapon. And unlike the definitions needed and used in the Klinton Ban - Three Military Features - Sunstein wants it to be ONE. This would outlaw every 'Home Defense Shotgun' now sold and outlaw the buying of any used ex-Leo Shotguns as they have five round Magazine and 'short' barrels.

The current target of Sunstein's Ban (pun intended) is the Saiga 12ga auto-loading shotgun that has a 5 Round removable magazine and is styled after the M16, AR15. (It is a very cool weapon but the Russian Izhmash at $1,000+ is too much for me). But we know the commies, that would just be step one - 1st ban the imports then go after Mossberg, Remington, winchester, etc, etc, etc.

Annnnd -- the Rats in Congress also want to ban 'Assault Magazines' used in handguns; Yep that what they're calling them. Thankfully that will be DOA in the House -- for now anyway. So I expect Sunstein to pick up that ball and run it over to the ATF too! As such, I'll raiding the 'Cookie Jar' and getting my 'Assault Shotgun' asap. Plus that Yugo SKS 'assault rifle' with the neat 'NATO Grenade Launcher' that I've been putting off. And if there's any 'Cookie Money' left, a nice .45 Auto (or another 9mm) that will take one of those 'Assault Magazines'.

So when those Marxist Mexicans come a knockin' to 'take back their stuff', they better bring a lunch. And some Burritos for dinner cause it's gonna be a loooong day for them.

How about the SCOTUS (yes, the supposedly "conservative" SCOTUS in 2007) ruling that CO2 is a "pollutant" despite the fact that congress did not intend the Clean Air Act to regulate CO2?

How about Plyler vs. Doe 1981 (Texas has to pay for school for illegals), another misinterpretation of the 14th amendment, despite the fact that the authors of the 14th said it does not apply to illegals?

I never can predict what the SCOTUS is going to do. It often defies reason, especially with bleeding heart issues.

A couple of other unfortunate factors:

It takes so long for an appeal to get to the SCOTUS that the number of illegals (or whatever non-citizen category congress defines) would increase dramatically by the time the SCOTUS rules. Then they could argue that they are in legal limbo, and that deportation or being expelled from a "path to citizenship" would be out of the question.

Imagine Obama is reelected and one of the relatively conservative justices has to be replaced....

But as you said, at least for the time being, no amnesty can pass congress.

You did not read my comment carefully. All your examples were the O’ Conner SCOTUS or before. I specificly said that this court has overturned things the prior court approved like that part of McCain-Feingold Citizens United.

O” Conner was a loose gun and had no consistent philosophy. She gave homos a Federal constitutionally protected right to engage in homo sodomy yet 20 years early she ruled against a similar right.

This Scalia/Roberts court is a big improvement over her decisions, something GWB did right.

Sorry, but O'Connor was not on the court in 2007 when SCOTUS ruled that CO2 was a pollutant (thanks Anthony Kennedy). My other examples did fit your description.

I wish Ah-nold and Bloomberg would have an emigration meeting. Ah-nold could go back to Austria (may have lost his citizenship when he became a US citizen). Bloomberg is Jewish so Israel would have to take him.
