Montana judge rejects gay couple rights suit

HELENA, Mont. (AP) - A Montana judge on Thursday rejected a lawsuit that sought to extend to gay couples the same legal protections as married couples, saying in his decision that he can't grant the benefits partly because of the state's voter-approved constitutional definition of marriage as between a man and a woman. Last year, the American Civil Liberties Union filed the lawsuit on behalf of the gay couples, arguing that the guarantees in the Montana Constitution of equal protection, privacy and dignity should require the state to afford the legal rights to the gay couples. The ACLU said it plans to appeal the case to the Montana Supreme Court.

Sherlock pointed to similar cases in Vermont and New Jersey that successfully ordered the states to allow the common benefits and protections of marriage to gay couples, even if they are not allowed to get legally married. But Sherlock said neither state had a constitutional marriage provision like Montana.

Wow, a judge that follows the State Constitution, Kudos to Judge Sherlock.

Both lists. This shows how not only homo-agenda pushers get their way, but all manner of leftist agenda pushers get their way, commonly with the assistance of the ACLU. Crosses taken down from hilltops and on private property, 10 commandments prohibited from courthouses, Nativity scenes verboten from parks, Boy Scouts renting city, county or state facilities (and fixing them up, and paying money) getting kicked out, no prayers at meetings (because one professional atheist protests) and so on - the freedoms of speech, religious expression, association - all destroyed by judges. The left knows that they cannot win with votes, so they do an end run and get leftist lawyers and judges to rule against the primitive knuckledragging hoi polloi who still believe in God and morality.

Another point is that the destruction of traditional aka "Real" marriage and family is one of the stated goals of the homosexual agenda pushers, and since the natural family is the bedrock of human civilization, the attack on marriage is a blow to the heart. Fortunately this is an intelligent and worthy judge.

Yes Thank the Lord for judges like him. The perverts will never ever take no for an answer though, they will try again and again and again. They never give up, look at CA. States, like MT are not immune because they have an Marriage Defense Amendment, those are simply invitations to challenge them.

Does anyone know how the MT Supreme Court leans? If I remember, they issued a rather liberal opinion within the past couple of years regarding recognizing “parenthood” of an unrelated lesbian in a squabble/split-up between the perverted couple.

Since CA’s marriage amendment has been struck down by a federal court and the 9th circus is reviewing that decision, Sherlock’s state ruling may not matter for long.
