9th Circuit will hear eligibility arguments [But attorneys say dispute involves much more than BC]
WND ^ | April 29, 2011 | Bob Unruh

Only days after the White House released a copy of Barack Obama's "Certificate of Live Birth" from Hawaii, claiming to have put to rest the dispute over his eligibility to hold the office, attorneys will argue on Monday before the 9th U.S. Circuit Court of Appeals that the requirements of the U.S. Constitution simply are too important to ignore for the sake of political expediency, even when they involve a sitting president.

The case has been pending since the 2008 election. The plaintiffs alleged that Obama's qualifications were not checked properly, and that has resulted in a violation of the U.S. Constitution, a man occupying the Oval Office who does not meet the requirements that only a "natural born Citizen" can hold the office.

California attorney Orly Taitz told WND today that her hope is for a decision that will return the case to the district court for proceedings, which could include a discovery process through which a large number of Obama's life documents could be obtained.

Another set of plaintiffs is being represented by Attorney Gary Kreep of the United States Justice Foundation.

"What I hope comes out of the case is that the 9th Circuit will remand to the trial court for further proceedings, allow us to take depositions, subpoena witnesses and evidence to find out the truth," Kreep told WND.

"Let's assume the [White House-released birth] document is the real thing, that it's an actual copy of the birth certificate. There's still the issue of his half-sister [Maya Soetoro-Ng] who reported him being adopted by the Indonesia stepfather [Lolo Soetoro]. That raises legal questions. Maybe he lost his citizenship. There's also the issue of him traveling to Pakistan…"

I hope the plaintiffs don’t get sanctioned.

You told me it's going to court and it looks like it, but I still bet it gets thrown out :)

Enjoy!

You know, there is much lower hanging fruit to hit Obummer on than this.

“There’s also the issue of him traveling to Pakistan…”

Oh, really?

I wonder which issue that would be?

I don’t think that even economic reality will have and effect on zero’s re-election chances. The media has already started telling us that we are now accustomed to having sky high energy and food prices. When the usurper has 100 percent of media, academia, entertainment, sports and unions behind him, who is going to rival that?

Supposedly, Pakistan was off-limits for Americans at the time Zero traveled there — similar to Cuba today.

So did he travel there on an Indonesian passport he kept after leaving his Indonesian home as the child Barry Soetoro ? By opting to use an Indonesian passport, he would be opting out of his US citizenship.

The debunking of this says that he simply went somewhere else first and didn’t travel directly from the US, therefor nobody stopped him from going and using a US passport.

The 9th can sometimes surprise folks.

They recently ruled that the recent 2nd Amendment USSC ruling should be incorporated to the states.

Alan Keyes claimed recently that the issue has never been tested in any court. So I poked around a bit and found United Sttates v. Won Kim Ark.

I know it's wiki but it's a starting point, and I could pursue it through other sources. There are other cases and situations mentioned.

United States v. Wong Kim Ark

I've not made up my mind one way or the other, seems like better minds like mine have wrestled over it, and there is no consensus. Col. Lakin's career is effectively ruined; I wish they'd decide on it if just for him. He is no real threat to anyone, guess they had to make an example of him.

The ninth circuit? Aren't they out of San Fran? It sounds like San Francisans are ticked at Obama this week, right? Maybe they will show their anger in their decision.

I don't know what sends your pessimism up so high. If you haven't noticed, everyone is upset with his performance. Just look at the polls. Blacks and Latinos are leaving him. He is in a very real free fall that I don't see him getting out of. Even his own Gurus admitted that they have no plan for the next election.

Just look at what he is doing and not what he says. He is hitting the base hard. Collages and radical groups like Rev. Al's convention to shore up the base. An incumbent should be focused on bringing in the middle at this point. Especially after the midterm wipe-out. Also remember that the Rats are in a heap of trouble with their Senate races just because the people up are very weak in moderate states. There will be a fight for cash in the party.

Some of the issues in the filing were a CT social security number, NBC status. It would be great if this led to subpoena of hospital records.

I do think Obama might find that some of the money will go to Senate races, that would normally go to him. If we can keep Obamas poll numbers down, libs will look to build a fire wall or hold a fire wall in the Senate

They have been working on this since 2008. My understanding is both sides get 20 minutes to argue their case. Not sure any other lawsuit has made it this far.

If it helps surface more facts about this administration, its a good thing.

That has been debunked dozens (maybe hundreds) of times on the birther threads. Where have you been?

Orly could argue her case for 20 minutes, 20 days, 20 weeks or 20 years.
