WASHINGTON — The Supreme Court ordered California on Monday to release tens of thousands of its prisoners to relieve overcrowding, saying that "needless suffering and death" had resulted from putting too many inmates into facilities that cannot hold them in decent conditions.
It is one of the largest prison release orders in the nation's history, and it sharply split the high court.
Justices upheld an order from a three-judge panel in California that called for releasing 38,000 to 46,000 prisoners. Since then, the state has transferred about 9,000 state inmates to county jails. As a result, the total prison population is now about 32,000 more than the capacity limit set by the panel.
Justice Anthony M. Kennedy, speaking for the majority, said California's prisons had "fallen short of minimum constitutional requirements" because of overcrowding. As many as 200 prisoners may live in gymnasium, he said, and as many as 54 prisoners share a single toilet.

As Leon used to say from the Barber shop in Dallas in regards to the “extreme conditions” foisted on prisoners in Texas: I lived in a tent in Germany for two years and all I said was I do.
“5 minutes every 5 hours is insufficient? We’re talking prisoners here, not hotel guests. Chamberpots for any pressing needs.
Remember, the alternative is releasing 30,000 prisoners into society pre-rehabilitation / time-served. These are people who can’t even get out on ankle-monitor parole.”
You can’t schedule your toileting so precisely. You can schedule meal times precisely. But not toilet needs so to the minute.
I’d rather have the mess than the early release. But I am advocating some porta potties here, I think that is more in line with constitutional guidelines.
How about step one...deport the illegals.
I’d agree with the chamber pots, too, as long as they get emptied reasonably.
I think the Supremes should order prison building or porta pottie installations rather than ordering prisoner release.
Can the FEDS come and take all the prisoners in CA that are not legally in this country OUT of this country?? As well as all of their amigos who have NOT been jailed but are EQUALLY illegal????? It would solve 99.9% of California’s problems.
Yup, that's certainly an obvious first step. California is more likely to coddle its illegal criminals than deport them though.

I would estimate there are over 50 people per toilet in the office building I work in. Non-managers are crammed into cubicles measuring 6 feet by 6 feet. The restroom is a place to be studiously avoided. These are professionals, most with master’s degrees and PhDs, being treated like this.

I wouldn’t worry to much about that. If you’re a criminal, why on earth would you leave Calif.? Few of the citizens are armed and on the remote chance you get caught, the state can’t afford to keep you in jail anyway!
