DOJ letter:'TSA would likely be required to cancel any flight'(FEDs threaten air blockade of Texas)
The Lone Star Report ^ | 5/24/2011 | Andy Hogue

The U.S. Department of Justice sent a letter to House and Texas Senate leaders Tuesday -- reportedly in person -- threatening a shut-down of airports if HB 1937 is passed.

The letter claims Rep. David Simpson's (R-Longview) anti-TSA-groping bill is against federal law and the Supremacy Clause of the U.S. Constitution. We include the text of the DOJ's letter, as well as a portion of Simpson's reply, below.

it’s irritating how this administration is quick to pull the legal and constitution cards when it suits their purpose and ignore and trample the law and constitution when convenient

No idea why the federales would shut down airtravel. All they need to do is get one of the gropers arrested by Texas authorities and walk into court immediately and say "in the performance of his duties" and the judge will turn him loose. The law is not enforceable as long as the TSA agent is a public employee. If he's a contract employee that might be a little different. On the other hand if TSA lets the employee be arrested, tried and convicted, and simply shuts down air travel, ALL the TSA employees in the entire United States will WALK OFF THE JOB.

That would fall into the "how dare you defy us!" category.

the fairy was over in the Uk today lecturing the Uk about who they are at war with and did his usual outreach to islam and muslims, mention slavery etc then went into the respect for law

What law is he talking about because this admin is making laws up as they go along, suing states and police depts for defending the law and then ignoring other parts of the law like DOMA.

He stood there today , the same man who has no clue what town he is in on most trips and does not even know how many states or what year we are in.
He stood there thinking he was the leader of the world and yet all he is , is a puppet for Soros

Secede?

I am not for it, BUT if we did, we could elect to control our own airport inspection, oil production, school system and banking industry. We might has such an influx of population that the U.S. Treasury might find it difficult to compensate for the loss.

The real solution is to take the entire country back and throw the Lying Commie Bastards out or in jail.

“...anti-TSA-groping bill is against federal law and the Supremacy Clause of the U.S. Constitution.”

How can that be when the COTUS provides a specific protection against unreasonable searches and seizures?

Ok, so the gubbermint is so determined to keep us safe when we fly. We can't have anything that may be considered a weapon or someone on the ‘’watch list’’. Fine but wait a second, what has it done to secure our border between Mexico and our country? They have to realized how dangerous the border is, so why are they copping a feel now and then or grabbing a guy's ‘’stuff’’ when there is a higher probability of some serious bad guy coming in without the fear of getting stopped/

You do realize that the TSA isn't just for flying right? So that line of logic is a failure.

The TSA is now providing security for proms in NM. Is that constitutional?

the Govt needs to get rid of the TSA and go back to private companies, then sell off Amtrack like the Brits did under Thatcher. The Feds are ignoring laws while making new ones and the GOP are frigging silent and would rather attack each other because they want to think the media might like them

>>> Cite, the word you wanted was CITE. <<<

Technically correct. But given the actions of the DOJ as of late, even “sighting” the Constitution would be a step in the right direction.

Where’s Governor Gardasil on this?

Perry is a clown. The only people who fall for his fake cowboy act are people who don’t know anything about Texas.

As a Texan who watches Texas politics closely enough to have been around Perry more than once I am glad you folks have been watching too! Perry is a lightweight. He is not the brightest bulb. About the only thing he is good at is taking advantage of political "gaps" where the other candidate or candidates are bigger douches than he is. Perry has no real skills. In a way he is a like like Obama in that Perry has never really done much. Sure , he has been gov. of Texas but that is not a very strong executive position. Perry mainly has been looking for his next job. That is what he had in mind by pushing Guardasil and the Trans-Texas Corridor. Those were ways for him to make a buck once he got out of office.

If it become obvious that Perry could easily beat Obama then Perry will jump in to the presidential election. If it looks like work he won't.

Perry is a RINO and the last guy we need in Washington. He does have nice hair but why does that matter? We might as well measure finger length or maybe the length of something else:) The latter might be a good idea for all Republican candidates because I bet we would find no cajones attached as we say in Texas...

At this point I want to see Palin get in the race. Why? Because she is like Thor, she has a huge hammer because she is so well known. Like Reagan, Palin is a comfortable pair of shoes. People feel like they know her. Unlike Obama who nobody knows. Even Obama.

So, no thanks when it comes to Perry. We already have a wind up doll in office now. We don't need another.

Texas should counter with it’s own No-Fly List of potential terrorists who will be prohibited from flying into/out of Texas.

Better yet, we could come up with our own Trusted Traveler Program like the Israelis where you can get cleared with a background check and then have a biometric ID.

Why isn’t the Republican house shutting off the money for TSA? Sometime you need to starve the effing beast.

What decent citizen would molest children just to collect a paycheck. One that has probably been in jail or avoided jailtime due to PC judges.

The TSA is working on getting into AMTRAK and subway trains, too, though. It’s not just about flying.
