In statements made to detectives after the shooting of Guerena, one deputy stated he opened fire after seeing a man pointing a rifle in his direction. He said he felt his own life and the lives of his teammates were in danger when he opened fire.

He was unsure how many bullets he fired.

Another officer stated he kept shooting “until his weapon ran dry” that is he ran out of bullets. He said he saw a muzzle-flash, and thought one of the officers had been hit, when he opened fire.

The big question still remains unanswered. Who fired the first shot?. Was it Guerena or a SWAT team officer? Did Guerena fire at all?

All of that is still under investigation at this hour. Sheriffs officials have declined to comment. The sheriff says he will release a statement, at a later date when he has more information to share.

No, there is no question about who fired the first shot. Mr. Guerena’s rifle had the safety on. And, the SWAT team did not allow medical first responders into the house. Mr. Guerena bled out.

That's not the big question. The big question is why do we have paramilitary organizations committing urban warfare against our homes? The burden of proof that we have a MAJOR drug dealer/terrorist/known suspect in a high felony such as murder/rape. We must know the ADDRESS. We must have high level of certainty that the perp is there and civilians are few if any. That should be minimum qualifications before even getting a warrant.

Apparently you are behind the times. It has been determined,and admitted to by the police, after several lies to the contrary, that the AR15 Guerena had still had on the safety and no rounds were fired by him. The stupid swat team didn't "serve a warrant" either, they broke his door down and gave every appearance of being criminals. This was murder pure and simple.

So, no, there is no big question, the question has been answered and these murderers need to be behind bars, along with the judge who issued the no knock warrant, a warrant, BTW, which has been sealed and blocked from public view.
