I think the case for recusal is strongest for Kagan, who was Solicitor General and actually helped prepare briefs in defense of the monstrosity.
But maybe we can cut a deal: if both Sotomayor *and* Kagan recuse themselves, Thomas will as well. (^_^)

It isn’t JUST that she doesn’t belong on the Court - she should be disbarred and charged as a criminal to boot.

That’s exactly how weiner wants you to think. The reality is there is NO reason at all for Thomas to recuse himself, and it is obvious Kagan should recuse herself. One does not cancel out the other - Thomas stays in - its Kagan only that should be out, period.

I didn’t suggest Thomas should recuse himself. I said if Kagan doesn’t, then Thomas shouldn’t. That doesn’t mean that if Kagan recuses herself then Thomas should too. It means that if the justice with the biggest conflict of interest won’t recuse herself, then certainly one with an imagined conflict shouldn’t recuse himself.
