Elizabeth Edwards’ revenge from the grave: She 'secretly recorded death-bed video testimony'

In a final act of revenge, Elizabeth Edwards secretly recorded a testimony in her dying days that helped prosecutors indict husband John last week, it was claimed today.

John Edwards is due to stand trial on charges that could lead to a 30-year jail sentence after he pleaded not guilty on Friday to using $925,000 in campaign funds to cover up an affair and love child.

The estranged wife of the former presidential candidate is alleged to have filmed a damning testimony that was central to the prosecution’s case for charges.

Friends said the cancer victim, who died in December, wanted to ‘haunt’ her estranged husband and his mistress Rielle Hunter, with whom he fathered a child and made a sex tape

Bruce Baron, an expert on federal law, said: ‘The value of a potential dying declaration, or tape, containing the testimony of Elizabeth Edwards, is devastating to any case or defence that Edwards would have.

‘On the secret video, Elizabeth spells out everything she knew about John’s affair with Rielle and how he managed to cover it up for so long,’ a source told the Enquirer.

‘She also spills all of John’s lies – many of which could be what sends him up the river.’

‘Elizabeth wanted to haunt John and Rielle – literally from her grave – and she has,’ the source told the Enquirer.

‘She hated them with a vengeance. This was a woman who took her final breath in the same bed where John once had sex with his mistress.’

Yes. One cannot be legally married to a dead person.

Stunning you would post that. No loyalty to him??? For over a year the media wouldn’t even report it (and longer because some knew). Until pictures came out in a rag magazine. No Democrats would comment...

That's party loyalty, not personal. No one in his life cares; the politicians and journalists only worry about losing his seat.

And it says she recorded it on her DEATH bed....and yet you claim her laying in a death bed speaking somehow used up energy that would have let her live longer. LUDICROUS.

Have you ever been extremely ill? I've nursed people with terminal cancer, which is what Mrs. Edwards had. Recording deathbed testimony could be exhausting beyond a scale you seem to comprehend. My grandfather summoned the energy to hold a new baby for several hours and to talk with the happy couple - and he took a dramatic turn for the worse once they left. I think connecting with the next generation was worth it to him, but even that used reserves he couldn't spare. I understand summoning that energy to share a positive joy, but to do it out of spite or revenge says volumes about Edwards.

Very sad when you think about it. Maybe she was trying to help get him out of her children's lives. Since her older daughter would take care of her other children if he couldn't.

I think that the privilege belongs to the husband in this case but it only goes to what he told her. What she observed and/or learned or heard from others is ok.

No==I just gave a short form The first privilege does not usually survive the marriage, as for the second(marital confidence privilege)-courts may require that the communication relate specifically to the marriage so it is of very limited application.

In no way am I standing up for John Edwards but what happened to having a right to face your accuser? A recording cannot be cross examined and as a woman scorned, she could have spewed a multitude of falsehoods. I don’t see how this would be admissible.

On another note, I truly hope this is just tabloid gossip and is not true. I would hate to think that her dying days were spent plotting this video rather than taking the precious little time she had left to spend with those she loved. I he she wasn’t this much of a tormented soul. God will deal with John Edwards.

I think so-called "dying declarations" are often admissable in court, even though "hearsay" is not.

The reason dying declarations are often admissible is that the dying person is presumed to not have a reason to lie. A scorned woman desiring revenge has a motive to lie.

Where's personal responsibility? Everyone blames John Edwards but Elizabeth made choices too and she died an angry, bitter, vengeful woman. The same way she lived.

Their children are to be pitied for the hand they were dealt.
