Alabama's Tough New Immigration Law Can Withstand Legal Challenges, Experts Say

Alabama's new law cracking down on illegal immigrants will likely survive legal challenges from advocacy groups that say it is unconstitutional and racist, analysts told Fox News.

The law, which takes effect Sept. 1, empowers police to arrest people suspected of being an illegal immigrant if they are stopped for another reason and requires businesses and schools to verify whether workers and students are in the country lawfully. It also makes it a crime to knowingly transport or shelter illegal immigrants.

As soon as Republican Gov. Robert Bentley signed the bill into law Thursday, the ACLU and Southern Poverty Law Center were vowing to defeat it in court.

"It is clearly unconstitutional. It's mean-spirited, racist, and we think a court will enjoin it," said Mary Bauer, legal director for the Southern Poverty Law Center.

"By signing this bill into law, Gov. Bentley has codified official discrimination in the state of Alabama," said Cecillia Wang, director of the ACLU Immigrants' Rights Project. "We will take action to keep this law from going into effect to ensure that the civil rights and liberties of all Alabamans are protected."

Legal experts told Fox News that they expect the case to head to the Supreme Court where they believe the state will prevail.

"I think the states have the right to do this," said Jay Sekulow, chief counsel for the American Center for Law and Justice. "I think it will be successful."

Many states are sick of illegal immigration and when passing these laws the leftists go ballistic.

The liberals might boycott Alabama. How’s the boycott of Arizona going?

I had to LOL when Los Angeles had to modify their Arizona boycott. Turns out that LA gets lots of electricity imported from Arizona. Getting power to charge up the Ipods, Ipads, and watch cable TV and run the jacuzzi trumps high principle about supporting illegal aliens in la la land.

There are parts to the law which won’t hold up. If you stop for a hitchhiker....you have to ask about nationality...otherwise, you could be accused of transporting an illegal. This particular part of the law has looked upon as a bit stupid by the locals.

The rest of the law will be challenged...but I suspect most will stand up in court as well as the Arizona law.

It's time that the ACLU should be paying all legal fees for both sides for the cases they lose, there’d be a lot fewer frivolous suits filed by them.

A sterling suggestion. Perhaps Alabama citizens can demand that the state’s AG prosecute. I’m tired of seeing patriots on the defensive. Time to go for the left’s throat. The commie ACLU is a good place to start.

And as a concomitant strategy, threaten a boycott of businesses that advertise in the leftist media. It’s time to bury these Goebbel’s propagandists.

The liberals seem to have a catch phrase to belittle anything that's American and wholesome. Oh when, oh when, will we rid our country of the true evil, which is liberalism in all its forms? (Rhetorical)

Texas has the biggest Republican majority, in its statehouse, in its history. Rick Perry could push for this in Texas.

Unfortunately, he’s too chiken chit to do it. And his cheap labor loving RINO friends in the legislature squash every
anti illegal alien bill that is filed.

Sad.

To these people anything that protects the meaning of citizenship especially as to our Constitution and state’s rights is ‘mean spirited’ and probably ‘racist’. Makes a person wonder if this isn’t the pot calling the kettle black.

Exactly, and even if a law is constitutional they seem to work in the mean spirited part if they don't like it.

At least the Dem Party of old had conservative Dems, now they're liberals or worse.

If there's a dem who claims to be conservative anymore, I don't know who it is. Joe Lieberman comes close on the single issue of national defense but that's the only issue where he even comes close.

I liked Zell Miller a lot because of his right out front patriotism but am not that familiar with his stance on other issues.

No, there are no conservative Dems any longer and in my original post I meant to say some cons Dems.

Like you said, Lieberman is conservative on defense but a flaming liberal on most everything else.

Miller was a true patriot and was what I'd call moderate on many things. Read a book on him many years ago, can't remember the name of it but it was the type I didn't want to put down.

People should just file suit against the ACLU for whatever reason they can find. It would keep them busy defending the lawsuits and at the same time reduce the amount of money they can use to attack. A death by a million cuts so to speak.
