In a strongly worded legal brief, the Obama administration has said the federal act that defines marriage as being between a man and a woman was motivated by hostility toward gays and lesbians and is unconstitutional.
The brief was filed Friday in federal court in San Francisco in support of a lesbian federal employee's lawsuit claiming the government wrongly denied health coverage to her same-sex spouse.
The Justice Department says Karen Golinski's suit should not be dismissed because the law under which her spouse was denied benefits — the Defense of Marriage Act — violates the constitution's guarantee of equal protection.
"The official legislative record makes plain that DOMA Section 3 was motivated in large part by animus toward gay and lesbian individuals and their intimate relationships, and Congress identified no other interest that is materially advanced by Section 3," the brief reads, referring to the section in the act that defines marriage as being between a man and a woman.
Though the administration has previously said it will not defend the marriage act, the brief is the first court filing in which it urges the court to find the law unconstitutional, said Tobias Barrington Wolff, a law professor at the University of Pennsylvania.

I think it is a bit of both. He is a buffoon (forgetting who he presented the MOH to, etc.) and a trained radical with a plan.
I’m sorry, it’s not the President’s place to say what is Constitutional and what is not.
Don't even joke about it! He's young enough the next Dem administration could appoint him! He wouldn't be the first ex-president to join the court. William Howard Taft did so as Chief Justice.

You're hitting on the reason it's a choice and not biological. Their unattractive appearance limits their romance, so they gravitate toward one another in sympathy and need. Understandable? Yes. But also debauched and an abomination. As humans, God expects us to live our lives to His service. Our bodies are a gift, and we should live in respect of that gift. That means we have to be strong enough to overcome the base passions we're born with. That's part of our commitment to Him. They aren't strong so give in. They're apart from God.

Wouldn’t a 14th Amendment argument against DOMA also apply to any restrictions in marriage laws? For example, restrictions against cousin marriage and poligamy?

Not obvious to me and you frankly don’t belong on this forum. We do not support the gay agenda, gay marriage or gay rights. Period. I suggest you’ll be happier somewhere else where your views will be accepted.
