Court rejects Obama bid to stay inmate's execution

The U.S. Supreme Court today rejected a bid by the Obama administration to spare the life of a Mexican national set for execution for the 1994 rape-murder of a San Antonio teenager.

Curious. Since this same issue has come up in Texas twice before. Once when Bush was governor. Once when he was President.

In the first case, he allowed the execution to proceed. In the second, he took no action to stop it.

Bush instructing Texas to review the convictions and to reevaluate the sentencing of Jose Medellin, a Mexican citizen in the same position as Garcia. In 2008, the Supreme Court ruled that states were not obligated to comply with the Vienna Convention, and that only Congress — not the president — could force them to obey the treaty. Later that year, Medellin was executed.

I believe I heard correctly that a guest on Mark Levin’s show said this murderer was brought to the US when he was two years old. But he, or his attorneys found some great affinity for things Mexican once he was convicted of murder.

If that is correct, then those using this case to invoke some international agreement are even more absurd in their actions. Heck, this guy is Dream Act material, probably knows nothing of Mexico...

The SCOTUS is an abomination.

There is no rule of law, only what a bunch of appointed for life unaccountable degenerates in black robes decree.

If they cant be unanimous on this (and it could have just as easily went the other way depending on what Kennedy had for lunch that day),if 4 of 9 will support a murderer at the request of a democrat justice department and would change their vote the other way if the request came from a GOP Justice dept, then it is a danger to the American citizen that makes the camel jockey ragheads in the middle east pale by comparison.

Breyer, Ginsburg, Kagan , and Sotomayor are nothing more than marxist stooges installed by fellow travelers and confirmed by socialist crook democrats and spineless coward Republicans.

Leal had contended in earlier appeals he should have been allowed to pursue an appeal after President George W. Bush in 2005 agreed with an international court ruling that Leal and 50 other Mexican-born inmates should be entitled to new hearings in U.S. courts to determine if their consular rights were violated at the time of their arrests.

The U.S. Supreme Court subsequently overruled Bush and the impact of the International Court of Justice decision. The 5th U.S. Circuit Court of Appeals cited the Supreme Court's ruling in denying Leal in 2009.

To remedy the violation, the ICJ ruled that the U.S. must review Leal's conviction and sentence. The administration of George W. Bush affirmed the ruling and told Texas to reconsider the case. However, in 2008, the U.S. Supreme Court, in Medellin v. Texas, voted 6-3 that President Bush had no right to impose his authority on the state of Texas unless Congress passed legislation making ICJ rulings binding according to U.S. law.

Without such federal legislation, Texas officials refused to comply with presidential requests, and they now intend to go through with Leal's execution on July 7.
