Jessica and Craig Porter of Somerset, Wis. have their newly adopted baby’s room all ready, but the shutdown is forcing their new son to sleep in a playpen across the river in Minnesota. The family is stuck at a hotel until lawmakers strike a budget deal and the state shutdown passes. “We’re just so happy to be with him. We’ll probably go through anything to bring him home,” said Jessica Porter. Her baby boy, Ezra, is only 5 days old. He and his parents are living in a Stillwater hotel room, because they can’t go home to Wisconsin until his adoption paperwork is done.

The press is just overflowing today with stories about how the world is coming to an end because the Minnesota government has shut down. (supposedly they can’t buy Miller Beer up there either). This is trial-balloon central for the Obama strategy.
We had a similar thing happen to us last September, though not quite as bad. Our paperwork to complete our adoption got held up by a furlough day in GA on the Friday before Labor Day. Had their office been open we would have been home that Friday instead of the following Tuesday. It’s just a few days extra, but we had already spent 4.5 weeks in GA and were more than ready to head home.
They make it out to be some permanent crisis. It’s temporary lay off for state employees. A paid vacation for many.
How many private sector folks have been laid off for months, if not years?
Hmm...I knew a family in Louisiana that adopted. They got temporary custody. The judge made them come back for several months after they thought it should have been finalized. They thought the judge was just trying to make them angry so they’d lose the child. They kept their cool and were eventually awarded parenthood.
Are there any Wisconsinites out there? Would DCF seize this child immediately upon entry into Wisconsin? I don’t believe it but maybe I’m wrong. Now yes the couple won’t get official parenthood until the shutdown is over but I can’t believe they’d lose custody.
When Tennessee’s government shut down a few years ago I had to go back to the car dealer twice to get an extension on my temporary tag. I even drove into North Carolina but the North Carolina police didn’t seize my vehicle at the border.
Two programs for families and children could lose funding Aug. 1

Two state-funded programs for families and children in Dakota County - which survived the state government shutdown this month - will see funding go away next month.
If the shutdown continues, funding and services will stop beginning Aug. 1 in Dakota County for the state’s Family Support Grant, which provides caregiver help for families with disabled children, and the Child and Teen Checkup preventive health care program.

I’ve thought about this case some more — the only way it makes any sense is if the adoption agency has expressed a preference to place the child with a family that *can* get the adoption finalized as soon as possible.
However if that is the case, I would recommend that the couple cooperate with the adoption agency, even if that means returning the child to the adoption agency for placement with another family, as much as that hurts. It appears they have a long way to go before the adoption is final — if the agency tells the court that the family was uncooperative, they won’t get the adoption.

By law, you are not allowed to move the adopted child from his originating state until the Interstate Compact on the Placement of Children (ICPC) is approved by both the receiving and the originating states. We have done interstate adoption twice. Nobody checks on you to confirm that you are still in the state with the child. However, if you do take the child out of state prior to ICPC approval, and something happens - car accident, illness requiring hospitalization - that could come to the attnetion of either the adoption agency or the state, you could lose custody.
