Days after the Obama Administrations attempt to seize control of the U.S. budget was roundly shown to be illegal, Sen. Mitch McConnell (R-Kentucky) and Rep. John Boehner (R-Ohio) have stepped up to show that Republicans want to tear up the Constitution too.
Instead of letting the president usurp Congress budget-making authority, McConnell is now offering to give it up freely. APs David Espo writes that under McConnells plan

Nothing illegal or unconstitutional in that.
The president is not required to use all of it (though he will) and it has never been mandatory for him to yse all of it.
Boehner just said on Greta's show that there is no SS trust fund. It all comes out of the general fund. He said that treasury secretary gets to decide whether to pay SS recipients or not.
We did not elect the Treasury secretary. Congress is giving away their responsibilities.
Congress has control of the purse strings. He is handing over the purse strings to the executive branch. He could easily call the House back into session and pass bills to continue SS, military, debt payments. He thinks the American people are stupid.
We need another march on Washington before it is too late.

It's not that simple. It looks like a debt increase occurring over the objection of a majority of Congress; and if a majority of Congress votes against more borrowing, then Congress can't be found to have exercised its constitutional power to borrow money.
Anyone else curious as to why the politicians went straight at Social Security? There are plenty of other third rails, this one should have been a back pocket "plan b" as politics goes; not a played up front so far out from the election.

That's okay as far as the debt limit goes, but as I understand it, the deal also includes handing Obama the sole power to choose the deficit reduction items, limited only by Congress needing a 2/3 majority to override his choices.
If Obama eliminates something like business tax deductions as his deficit reduction items, he'll be able to do it without a simple majority in either house of Congress being able to stop him.
That certainly doesn't seem like it fits with the Constitution.

Regardless of what else is in it, the authorization to raise the debt ceiling will be severable from the rest. Perfectly legal. Done all the time (Obamacare was a rare mistake).
