“A question I have asked many for the last two years concerning our President. If his presidency is illegitimate then should he not be held accountable for military KIAs due to orders he has given. People want to downgrade the importance of his birth certificate and his legitimacy as President, but there are serious ramifications here if it is discovered he is not eligible to be President thus giving unlawful orders that result in the deaths of many military service members.”

AS well as every thing else he has done in his official capacity as POTUS, to include appointments, nominations, bills, laws, treaties, name it.

It’s in his discretion to say that doing so would have a negative effect on retention and recruitment. But he won’t, because he’s a Progressive.

Who said the “sitting president is eligible to give said order, and if ineligible to sit as president, is said order then lawful?

well no one with any authority in our Government has said Obama is not eligible to be President. I happen to personally believe Obama is ineligible but who am I but just a FReeper? I am not aware of a single member of Congress making the case he is not eligible. So from a pragmatic standpoint your statement is meaningless. The solution is not to expect the Military to disobey legal orders but for us to seek impeachment and we all know that won't happen.

he can’t defy a lawful order given by the sitting president. there isn’t much else to say about it as far as his involvement in this goes.

Panetta is not a soldier. He can tell Obama to pound sand on any order he issues. Obama can fire him. That's about it. But Panetta is not bound by any order Obama issues.

If Panetta thought this was an order that would harm the military, he would be duty bound to tell Obama that he is not going to carry it out. Then Obama would have to fire him and appoint a new lackey to carry out his vile orders.

I hate this. But the teachers unions have been promoting this for 10 years. The teens today think it’s normal. I’m going to be an 80 year old grandma and I’m going to be looked at as a racist 80 year old grandma back in the 70’s. The only difference is, I’m not F’ing my same sex partner. They signed off on it about 2 weeks ago.

So is every branch leader going to confirm and sign off that the repeal will not harm the military. I thought two of the armed service branch chiefs were wary of this?

Apparently they all have already signed off. According to the AP:

“His decision, which was expected, comes two weeks after the chiefs of the military services told Panetta that ending the ban would not affect military readiness. Dismantling the ban fulfills a 2008 campaign promise by President Barack Obama, who helped usher the repeal through Congress and signed it into law late last December.”
