Requiring immigrants to speak English 'breaches human rights,'

A new immigration rule requiring people to be able to speak English to move to the UK to be with their spouse is a breach of human rights, a court heard today.

A couple have launched a judicial review at the High Court to challenge the rule, which they claim contravenes their rights to a family life, their right to marry and constitutes discrimination.

British citizen Rashida Chapti, 54, and husband Vali Chapti, 57, are applying for him to join her in the UK.

The couple have been married for 37 years and have six children together. Mr Chapti is an Indian national and does not speak, read or write English.

Mrs Chapti has reportedly been travelling between India and Leicester for around 15 years but has now applied for her husband to come and live in the UK with her.

But under new immigration rules announced by Home Secretary Theresa May in June 2010, he cannot do so due to a new English language requirement for migrants applying to come or stay in the UK as a spouse. The rule, which came into force in November last year, is thought to be part of the Government's pledge to reduce net migration.

But the Chaptis, along with two other couples, have launched proceedings to contest it.

At the High Court sitting in Birmingham, Manjit Gill QC, representing the couple, told the court the requirement was a breach of their human rights.

Replace Indian’ with mexican’ and it mirrors our own foreign leeches in this country.

It is difficult for those of us who are older, born during WW2, and served later in life in our military, to have a vision of a Europe that has lost all respect at all levels.

We so admired the superb leadership, especially in the UK. Such great allies and friends. Even France was once worth fighting to save. My father thought so, and gave his life for it -— and now what does his ghost see?

A liberal crap pile or mindless socialists who have let their countries fall apart and become overrun by the worst enemy of the Western world. And now he sees his own country headed that way.

Truly this is a nightmare never imagined.

I encounter Canadians all the time and they have all had the courtesy to learn english.

This despite the fact that English is the lingua franca in India, as well as the language of education and commerce there. Ergo, I suspect the point of this case is to force anti-acculturation legislation.

In this country, I’ve always thought that paying illegal immigrants in dollars instead of pesos was also a “breach” of their “civil rights”.

But requiring tax payers to fund multi-lingual education and print signs/forms in 27 languages is just fine!

So it’s a “human right” to live wherever you want but not have to learn the language.

Then why should I have to obey their laws? Or fumble with the immigration paperwork? It’s my right dammit to live where I want and with whom I want.

Considering the caste system in India, I find it rather hypocritical to complain about a breech of human rights.

Local teachers were scrambling for stimulus funds to hire bilingual teachers. They said that non english speaking students had increased by more than 50% over the last decade.

I wouldn’t marry someone I couldn’t communicate with.

The only way I see something like that happening is mail order brides.

I've lived a total of 17 years in two Asian countries and one non-English speaking European country. At NO point did I EVER expect ANY of the locals to converse with me in my native language - English. Also, if I'd had desired to become a permanent resident or citizen, I would have learned their languages even more thoroughly.

Note to all immigrants: If you didn't take a country by military force, you do not have a say in what language they speak or require immigrants to speak. Now shut-the-hades-up or go back to your native country. (that goes for you ex-pat Americans in foreign countries too!)
