The agency doesn't believe a crime occurred & the officer won't be cited for lewd behavior
SANTA FE, N.M. (AP) -- He's in uniform and apparently on duty. But New Mexico State Police said the officer caught on camera having sex with a woman on the hood of a car did not commit a crime.

The court found that screwing the public is part of the civil service job requirement. He was just performing his duty as a public servant to the best of his ability.
Everything is legal, if you don’t get caught.

After reviewing the picture I believe this officer was just involved in a normal traffic stop and was performing a detailed strip search...that included a cavity exploration.

There have been cops that have arrested men for.. uh, tinkling, near a building in the dark. Public indecency... which I find crazy unless the man is actually wagging it in front of people. If nothing else, and I mean nothing else, this officer should be charged “conduct unbecoming” and fired. Plain and simple. If this act isn’t “conduct unbecoming” then I don’t know what the definition means. IMHO
That’s what defense attorneys are thinking. Here’s precedent...you didn’t charge these two for having sex in public, so you can’t charge my client.

Absolutely. Any arrest in this jurisdiction for public indecency is automatically selective enforcement.
Did you expect him to be? The only tim that an officer of the law or a politician is ever charged when they commit a criminal act is when they tick off someone that is in a higher position of power that they are. It starts at the court house and goes to the white House. Or, from dog catcher to President.
