Retired Portland police and firefighters sue city to keep pension overpayments

More than 500 retired Portland police and firefighters and their spouses have brought a class action lawsuit against the city, arguing that Portland's public safety retirement fund breached their contract by trying to recoup nearly $3 million the fund mistakenly overpaid them in pension benefits.

The lawsuit, filed initially by five plaintiffs in Multnomah County Circuit Court, seeks to stop the Portland Fire and Police Disability and Retirement Fund from withholding pension payments that the fund's board says its members owe the city for miscalculations that occurred for over a decade.

The suit asks the court to award damages of $25,000 per retiree, as well as attorney fees.

You’d love it here in Oregon....lots of libs to loathe, haha. On a serious note, only in Oregon would this happen, I find Eugene bad, doesn’t compare to how left Portland is.

Well, let's say the guys in Portland fight that all the way to the Supreme Court and win ~ that would provide Postal retirees a doggone good precedent for "recovering" $78 billion in postal overpayments to OPM for pensions for postal workers.

Sounds like a deal!

On another note, I don’t think I’ve ever met a single conservative from Portland, I am hard pressed to find one friend among my circle that is right leaning. I don’t think there is one. Eugene sucks.

Michael Cullivan, 65, a retired Portland police lieutenant, said the fund has started taking $150 a month from his pension. "The pension board made the mistake. We didn't..."

Kinda sounds like he knew it was going on the whole time yet didn't speak up. Got any adults out there?

More government is needed to make the system more efficient so things like this can't happen anymore.

Some where, some how, some evil private company like Haliburton is the cause of this mess I just know it!

Ummm, nope. We’re talking about union Democrats here. “Gimme, gimme, gimme.” Mr. Cullivan is a retired police lieutenant, too. What’s this say about the mind-set of LEO’s in general? It’s only a crime if you get caught, but it’s never a crime if you’re an LEO.

I really doubt that. Pension calculations are so complex most of the time it is hard to imagine them getting them correct half of the time. I also wonder how they managed to figure out that the calculations in these cases were incorrect.

On a side note most of the time the pension calculation formulas are not available to the rank and file except in a very simplified form.

We need to move away from any form of state-guaranteed pensions and towards a philosophy of self-sufficiency. Tax-free retirement savings (tax-free contributions and tax-free distributions), with the worker having a much lower tax-level and higher take home pay. Pensions are bankrupting municipalities across the U.S.

We would have to phase this change in over time as it would not be fair to implement these changes to current recipients or those very near retirement now. Truthfully, pensions and all the social programs ever devised just have the effect of making people dependent on the state and increasing the political power of politicians who pretend to care about the "little man". These politicians then use the threat of reduced pensions to manipulate the public into voting for them.

I don’t think that the realities of our day are going to permit that.

Most of our states and local governments are in the same fix as was the former Soviet States after the fall of the USSR; Huge liabilities to pensioners and no money to pay them.

The other similarity to the former Soviet States that is still to come is rampant inflation. When that hits the state pensioners are really screwed. They will have to deal with a bankrupt state pension fund and double digit inflation (or higher thanks to the leadership of Obama and the Dimocrats) destroying their saving.

My employer Standard Practice Guide(s) and also on our paycheck stubs say if there is a mistake made in overpayment of any kind, it will be recouped from paycheck, pension, etc. So these folks know they were over-paid, kept the money, then sue to keep the over-payment of funds they were not entitled to?

Taxpayers in Portland should sue them back for “receiving funds not entitled”....
